CONSERVATION COMMISSION
INLAND WETLANDS AND WATERCOURSES AGENCY

SPECIAL MEETING

JANUARY 4, 2000

I. CALL TO ORDER

Chairman Howard Beach called the January 4, 2000, Special Meeting of the Conservation Commission/Inland Wetlands and Watercourses Agency to order at 7:00 p.m. in the Simsbury High School Amphitheater. The following members were present: Thomas Sharpless, William Nowak, John Yocom, and alternates Andrew Bucknam and Pierce Clayberger. Richard Miller arrived at 7:10 p.m. Laurie Whitten, Conservation Officer, was also present.

II. APPOINTMENT OF ALTERNATES

The Chaiman appointed Mr. Clayberger to sit for Karl Pech, and Andrew Bucknam for Helene Wade.

III. PRESENTATION - Discussion and Possible Vote

a. 15 Smokey Ridge Road - Inland Wetlands Permit

The applicant was not present. Conservation Officer Laurie Whitten presented this application of David Mullane for a permit to conduct regulated activities associated with the construction of a house addition and deck within the 75 foot regulated area from a wetlands and stream. Ms.Whitten explained that the 35'x25' addition was constructed without a permit last spring, and it came to her attention when the applicant came in for a permit for the deck, which will be about 35 feet from the wetlands limit. She stated that the permit for the addition was overlooked due to several changes in staff in the Building Department in the spring. The parcel slopes slightly toward the stream, but it is generally flat and grass has been planted. She feels that impact to the wetlands and stream should be minimal to none. The lot is stabilized, and silt fencing has been in place. The deck will be built on sonatubes. The commission had concerns that there was no site visit to verify that the lot is level, with grass, and that silt fencing is in place. After discussion the following was adopted:

MOTION: Mr. Sharpless moved that this is a Regulated Activity by reason of construction in the buffer zone to a wetlands. The motion was seconded by Andrew Bucknam and approved unanimously.

MOTION: Mr. Sharpless moved that this is a Significant Activity by reason of the potential to cause siltation. The motion was seconded by Andrew Bucknam and approved unanimously.

MOTION: Mr. Sharpless moved to NOT hold a public hearing due to there was no indication of public interest. The motion was seconded by Andrew Bucknam and approved unanimously.

MOTION: Mr. Sharpless moved to grant an inland wetlands permit with the following conditions: There be a site inspection by the Conservation Officer to determine that the site is level; that there is no substantial removal of brush or trees associated with the deck construction; that silt fence is still in place; that there are no signs of erosion; and that the project will be done with sonatubes and there will be no foundation. The motion was seconded by Andrew Bucknam and approved unanimously.

IV. ADJOURNMENT

MOTION: Mr. Bucknam moved to adjourn the meeting at 7:20 p.m. The motion was seconded by Mr. Sharpless and approved unanimously.
