III. PRESENTATION, DISCUSSION AND POSSIBLE VOTE

Application of Simsbury Hopmeadow Street LLC, Robert A. Bingham, Vice President of the sole member-Dyno Nobel, Inc., Owner, Errol B. Moore, Facilities Engineer-Dyno Nobel, Inc., Applicant for an Inland Wetlands Permit to remove and replace soil to install a concrete pad to mount a storage tank within the regulated area on property located at 660 Hopmadow Street (Dyno Nobel, Inc.).

A motion was made by Commissioner Sharpless that this is regulated activity by reason of construction within the 100-foot buffer area of a wetland possibly also in floodplain soil. The motion was seconded by Commissioner Winters, and carried unanimously.

A motion was made by Commissioner Sharpless that this is not a significant activity, as it doesn’t appear to have any potential for causing harm to adjacent wetland. The motion was seconded by Commissioner Winters, and carried unanimously.

A motion was made by Commissioner Sharpless that a permit be granted for the proposed activity with the proviso that any stored mounded material be monitored to prevent saltation to nearby wetlands.
The motion was seconded by Commissioner Winters, and carried unanimously.


Application of Fred Jardinico, Environmental Engineer- Dyno Nobel, Inc.-Owner, for an Inland Wetlands Permit for the removal, stabilization, and off-site disposal of soil from a former open burning/open detonation (OB/OD) area. Also backfill the excavated area to original grade, within the regulated area on property located at 660 Hopmeadow Street (Dyno Nobel, Inc.)

A motion was made by Commissioner Miller that is a regulated activity by virtue of excavation removal and filling in a wetland or an upland review area for the wetland. Commissioner Sharpless seconded, and carried unanimously.

A motion was made by Commissioner Miller that it is a significant activity because of the volume of material being placed as fill and removed and excavated either in the wetland or the upper review area. It was seconded by Commissioner Sharpless and carried unanimously.

A motion was made by Commissioner Miller that is a regulated activity by virtue of excavation removal and filling in a wetland or an upland review area for the wetland. Commissioner Sharpless seconded, and carried unanimously.

A motion was made by Commissioner Miller that the permit be granted on condition that there be properly maintained anti-tracking pads and that erosion sedimentation controls be put in place as stated in the application. They should be carefully monitored and maintained to avoid the wetland field delineated soils, using the chain link fence as a guide for the equipment drivers. There also should be a buffer around the base of the chain link fence to avoid the impact to the wetlands during the activity. The pads and the dirt roads should be maintained so as not to have spillage from potholes that might develop. The dirt roads should be well graded and smooth throughout the activity. Commissioner Sharpless seconded, and carried unanimously.

A motion was made by Commissioner Miller that although it is a significant activity; a public hearing is not required. The activity is a net improvement, the nearest abutter is a distance away, and the issues that would be of concern to the public that have not been discussed with this board fall under the purview of another commission. Commissioner Sharpless seconded. Four in favor with Commissioner Nowak opposed.


Application of Kevin and Mary J. Crimmins, Owners, for an Inland Wetlands Permit to construct a swimming pool within the regulated area on property located at 32 Walker Drive.

A motion was made by Commissioner Sharpless that this is a regulated activity by reason of excavation and construction in the buffer zone to a wetland. Commissioner Nowak seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that it is a significant activity in that it does have the potential for causing saltation to an intermittent stream. Commissioner Nowak seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that a public hearing is not required because no public interest in this project has been shown. Commissioner Miller seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that the permit be granted with the notification of the Conservation Commission officer. Commissioner Nowak seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that any stored material should be controlled to prevent any sedimentation into the wetland. Commissioner Nowak seconded, and carried unanimously.


Application of Wadworth T. Fyler, Owner, for an Inland Wetlands Permit to construct a driveway within the regulated area on property located at 47 Woodchuck Hill Road.

A motion was made by Commissioner Sharpless that it is a regulated activity by reason of construction in the buffer zone to a wetland. Commissioner Winters seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that it is a significant activity in that there will be fill and danger of sedimentation to the wetland. Commissioner Winters seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that a public hearing is not required in that no public interest in this project has been shown. Commissioner Winters seconded, and carried unanimously.

A motion was made by Commissioner Sharpless that the permit be granted. Commissioner Ursini seconded, and carried unanimously.

Application of W. Mark Wigmore, Owner, for an Inland Wetlands Permit to construct a barn within the regulated area on property located at 12 The Glade.

A motion was made by Commissioner Winters that it is regulated activity because it is in the 100-foot buffer zone of a wetland.  Commissioner Miller seconded, and carried unanimously.

A motion was made by Commissioner Winters that it is not a significant activity due to the flatness of the area, and that excess soil will be moved off site. Commissioner Miller seconded, and carried unanimously.

A motion was made by Commissioner Winters that a public hearing is not required due to the fact that it is not a significant activity. Commissioner Miller seconded, and carried unanimously.

A motion was made by Commissioner Winters to grant the permit with the condition that a barrier be placed so that excavators will not go into the wetland area. Erosion controls will be in place and excess materials will be moved off site. Commissioner Miller seconded, and carried unanimously.
