CALL TO ORDER

Chairman Miller called the meeting to order at 7:30pm at the Simsbury Town Offices in the Main Meeting Room The following Commissioners were present: Commissioner Zackeo, Commissioner Winters, and Commissioner Sexton. Also present was Conservation Officer Beach .


APPOINTMENT OF ALTERNATES

Commissioner Zackeo was appointed to serve for Commissioner Mihalic.


PUBLIC HEARING(s), DISCUSSION AND POSSIBLE VOTE

Application of John D. Ritson, Manager, R.C. Connectors, LLC – Owner, for an Inland Wetlands Permit to construct a building and associated parking lot within the upland review area to a wetland on property located at 146 Hopmeadow Street. (continued from meeting of 5/1/2007).

Conservation Officer Beach stated that Mr. Ritson has asked to extend the public hearing on this application until the next regularly scheduled Commission meeting.

Commissioner Winters motioned to postpone the hearing until the next Commission meeting scheduled for June 5, 2007. Commissioner Zackeo seconded with all in favor.



PRESENTATION(s)

Application of Nancy Taylor, Owner, for an Inland Wetlands Permit for maintenance of a small pond within the regulated area to a wetland on property located at 30 Fernwood Drive.

Ms. Nancy Taylor was present to discuss the application.

Ms. Taylor explained that a section of Nod Brook flows across her back yard. This section widens, forming a small pond, which is 125 feet long and 50 wide. The pond has silted due to a box culvert put in years ago by the Town to ease the flooding problem. Ms. Taylor wishes to dredge the sediment from the pond and utilize the material to fill in a depression on the property, located approximately 10 feet from the pond. The slope will be maintained and the area will be grassed. Ms. Taylor stated that the contractor, Mr. Roderick, will excavate approximately 2 feet of the pond. The excavating truck will access the brook by way of the right side of the house and through the woods.

The Commission discussed the idea of putting in a four bay at the commencement of the project.











A motion was made by Commissioner Winters that this is a regulated activity by reason of dredging in a stream channel. The motion was seconded by Commissioner Sexton, and carried unanimously.

A motion was made by Commissioner Winters that this is not a significant activity because excavation will occur at the far end of the pond to create a channel for the stream, hay bales will be used, the activity will occur during the dry season, and it is an improvement to the existing pond.
The motion was seconded by Commissioner Zackeo, and carried unanimously.

A motion was made by Commissioner Winters to grant the permit with the understanding that the applicant will abide by the stipulations set forth in the staff report, the dredge sediment will be stabilized, and the material will be placed in the depressed area after dredging occurs.
The motion was seconded by Commissioner Sexton, and carried unanimously.

Mr. Beach asked the applicant to contact him 2-3 days before the project is to commence.


Application of Beverly Sonen and Michael Anderson, Owners, for an Inland Wetlands Permit to expand culvert area to an existing seasonal creek and improve drainage around a new garage within the regulated area to a wetland on property located at 25 Pilfershire Lane.


Ms. Beverly Sonen was present to discuss the application.

Ms. Sonen explained that the Zoning Board of Appeals has granted her a permit to tear down her garage and build a new one. The second part of the project entails implementing overflow pipes to improve the drainage around the new garage.  During significant storms, the existing culvert at the stream on the property overflows. To help with this, two overflow pipes will be added to help with the overflow from the existing culvert. The existing culvert will not be disturbed.

A motion was made by Commissioner Winters that this is a regulated activity by reason of excavation in a stream channel. The motion was seconded by Commissioner Sexton, and carried unanimously.

A motion was made by Commissioner Winters that this is not a significant activity due to the fact that work will be done during the dry season, the project is small in scale, and most of the dirt has already been washed away.
The motion was seconded by Commissioner Zackeo, and carried unanimously.

A motion was made by Commissioner Winters to grant the permit with the understanding that the applicant will abide by the stipulations set forth in the staff report, the project will be completed during the dry season, and an armored head wall area will be installed.
The motion was seconded by Commissioner Sexton, and carried unanimously.


APPROVAL OF MINUTES of May 1, 2007

Commissioner Winters motioned to approve the minutes of May 1, 2007.
Commissioner Sexton seconded, with all in favor.











STAFF REPORT(s)

Commissioner Sexton said she will be attending session two of the DEP seminar.


DISCUSSION

West Mountain Road Development
Mr. Beach stated that the West Mountain Road litigation has been dropped. He explained that the owner has to go through the Zoning Board of Appeals. Mr. Beach informed the Commission that Mr. and Mrs. Kaplan have acquired lot #1 of Maglieri’s development.

Powder Forest Development
Mr. Beach explained that the Powder Forest Development did not need an excavation permit because they were moving material on the site, however, it turned out that they did remove material off site. Mr. Beach informed the Commissioners that the development is a private one and the road through the development is not town owned. Commissioner Winters stated that there should be some recourse on the part of the Town given the inconsistencies that have been revealed.

River Road
Mr. Beach said he will discuss the River Road project when Commissioner Mihalic is in attendance.

Lower Farmington River Wild and Scenic Study Group
Commissioner Winters said the group has had two meetings, and Ms. Reager is the Chairman.

Simsbury Farms Culvert
Commissioner Winters discussed the need for the culvert to fixed. Mr. Beach said that he and Gerry Toner spoke about this. Mr. Beach said he and Mr. Toner will schedule a time to go out and look at the problem
