SPECIAL JOINT MEETING
1. CALL TO ORDER
The Special Joint Meeting of the Board of Finance and the Board of Selectmen was called to order at 8:00 A.M. in the Main Meeting Room at the Simsbury Town Hall. The following members of the Board of Finance were present: Chairman Paul Henault, Peter Askham, Candace Fitzpatrick, Nicholas Mason, Anita Mielert and Kevin North. The following members of the Board of Selectmen were present: First Selectman Thomas Vincent, John Hampton, Joel Mandell, John Romano, David Ryan and Moira Wertheimer. Also present was Town Attorney Robert DeCrescenzo.
2. EXECUTIVE SESSION
Ms. Fitzpatrick made a motion to adjourn to Executive Session in order to discuss the purchase of development rights pursuant to Connecticut General Statutes section 1-200(6)(D) and a possible land acquisition. Mr. North seconded the motion.
Ms. Mielert expressed her concern that the assumption is that all meetings are open and that it is the exceptional case for a meeting to be closed. She felt that, in connection with the discussion of a land purchase it is the norm to go into Executive Session, but once the price has been set, it should be an open session and that, relative to the discussion on today’s agenda, the price has, for all intents and purposes, been set and, therefore, she felt that there wais no need to go into Executive Session. Mr. Mandell stated that the price has only been set on one side and that the purpose of this meeting was to discuss that issue and he did not think that you can negotiate a price in an open session. Mr. Henault stated that he was also under the impression that the price was fixed on one side and,
therefore, it would be detrimental to the Town for the Board to negotiate or have discussions around its portion of the transaction in a public session. He felt that an Executive Session was appropriate so as not to put the Town at a disadvantage. The motion passed 5-1 (Ms. Mielert voted “no”). The meeting adjourned to Executive Session at 8:03 A.M.
No action was taken and the Executive Session adjourned at 9:50 A.M.
