WATER POLLUTION CONTROL AUTHORITY
SPECIAL MEETING
MARCH 21, 2007
I. CALL TO ORDER
Chairman Frank Borawski called the special meeting of the Water Pollution Control Authority to order at 7:37 P.M. in the Room 106 at Simsbury Town Hall, 433 Hopmeadow Street. The following members were present: Warren Coe, Ed Kelly, and Phil Burton. Member Gary Faraci arrived at 7:40 P.M. Also present were: James Clifton, Superintendent WPC, Richard Sawitzke, Town Engineer, and Brian Smith of Robinson & Cole LLP. Phil Richardson and Paul Gilmore were absent.
II. EXECUTIVE SESSION
A motion was made by Mr. Coe at 7:41 P.M. to enter executive session to discuss possible land acquisition, pending litigation, and the sewer use boundary. James Clifton, Richard Sawitzke, and Brian Smith were invited to join the executive session. The motion was seconded by Mr. Kelly. Motion passed. All WPCA members present entered into the executive session.
At 8:22 P.M. Mr. Faraci moved to adjourn the executive session. Mr. Kelley seconded the motion. Motion passed.
III. PROPOSED ADJUSTMENT OF THE SEWER SERVICE DISTRICT BOUNDARY AND DEVELOPERS SEWER ALLOCATION
Mr. Kelley moved to adjust the sewer service district boundary in the vicinity of Firetown Road and Barndoor Hill Road, with the following considerations:
1) Approximately 30 acre area within the sewer service district, east of Barmdoor Hill Road and west of the wetlands and primarily located on Assessor maps E3 and E4, will be removed from the sewer service district. The area shall be designated as open space by the developer.
2) Approximately 30 acre area south of Firetown Road (lot 301) will be incorporated into the sewer service district. The sewer allocation for the area described above to be transferred.
3) The most recent development proposal, as detailed on Meadowoood: Settlement Plan Submission. Revision 03/20/07, Sheet 10, indicates that the approved allocation for the developable area currently within the sewer service district of 110,850 gallons per day will be significantly exceeded.
(a) If the developer wishes to exceed the approved allocation of 110,850 gallons per day, the developer must provide an engineering study with independent verification by an engineering firm selected by the Town, that details:
(i) The impact of the additional flow upon the carrying capacity of the sewers from the development and connecting to the North Interceptor
(ii) The impact of the additional flow upon the North Interceptor, with consideration of all potential upstream and downstream impacts.
(b) The developer assumes financial responsibility to remedy any capacity problems identified as a result of the engineering study that are attributable to the additional flow.
4) The proposed adjustment of the sewer service district boundary must be approved by the State of Connecticut Office of Planning and Management
The motion was seconded by Mr. Coe. Motion passed.
X. ADJOURNMENT
Mr. Faraci moved to adjourn the meeting. Mr. Kelly seconded.
