ZONING BOARD OF APPEALS
REGULAR MEETING
MARCH 22, 2006

I.      CALL TO ORDER

Peter Stempien called the regular meeting of the Zoning Board of Appeals to order at 7:33 P. M. in the Main Meeting Room of Simsbury Town Hall.  The following members were present:  James Daley, Lou George, Thomas Horan, Katie Martin, and Andrew Rose.  Also present were Howard Beach, Zoning Enforcement Officer, Lisa Arakelian, Commission Clerk, and other interested parties.

II.     APPOINTMENT OF ALTERNATES

Chairman Stempien appointed Andrew Rose to serve for Edward Cosgrove.

III.    PUBLIC HEARINGS – DISCUSSION AND POSSIBLE VOTE

A.      06-01  Application of Edward Jazlowiecki, Owner, requesting a rear yard variance to relocate a shed, pursuant to Article 8, Section A, of the Simsbury Zoning Regulations on property located at 15 Sachems Trail.  R-40 Zone.  

Edward Jazlowiecki explained that he is seeking to relocate a 20’ x 20’, two-story shed off of State property and entirely onto his own property.  The proposed new location is within the rear yard setback, but Mr. Jazlowiecki claims that this is the only location for the shed because of the topography of the land and the location of the leaching field on the property.  

There was a great deal of discussion between Mr. Jazlowiecki and Board members regarding other possible locations for the structure.

Chairman Stempien opened the hearing to public comment.

Carl Coppersmith, 13 Sachem’s Trail, gave a brief history of this application and spoke against the issuance of a variance.

Donald Smith, State Forester for State of Connecticut, Director of Division of Forestry of DEP, requested that the variance be denied.

The Board determined that the certified map was incorrect in labeling the rear yard as a side yard.

Chairman Stempien closed the public hearing.

The Board agreed that they could not determine a hardship in this case.

A motion was made by Mr. Daley to approve the variance.  The motion was seconded by Mr. Horan.  No members voted in favor of the motion.  Motion failed.

B.      06-02   Application of Fiddlers LLC, Owner, Richard Correia, Applicant, requesting a variance for blade signs, pursuant to Article 10, Section C.3.e, of the Simsbury Zoning Regulations, on property located at 2-10 Wilcox Street.  Simsbury Center Zone

Richard Correia explained that he is seeking a variance to the sign regulation to allow a 37-1/4-inch blade sign, a sign that extends away from the building as opposed to a sign that sits flat against the building, for Mr. Joseph’s Salon to be installed on the front of the Fiddlers’ Green building facing Wilcox Street, as patrons are having trouble locating the salon and creating a safety hazard by wandering along Wilcox Street.  Current zoning regulations stipulate that signs shall not project more than 15 inches from the surface to which it is mounted.  Mr. Correia further stated that Fiddler’s Green already has two approved blade signs on its property.

Chairman Stempien opened the hearing to public comment; hearing none, Chairman Stempien closed the public hearing.

A motion was made by Mr. Daley to approve the variance on the basis of safety.  The motion was seconded by Ms. Martin, and unanimously approved.

IV.     ELECTION OF OFFICERS

A motion was made by Mr. George to nominate Mr. Stempien to serve another term as Chairman, and Mr. Horan to serve as Secretary.  The motion was seconded by Mr. Daley, and unanimously approved.

V.      APPROVAL OF MINUTES

        A.      December 21, 2005

A motion was made by Mr. George to approve the minutes of the December 21, 2005 meeting, as presented.  The motion was seconded by Mr. Daley, and unanimously carried.

VI.     ADJOURNMENT

        A motion was made by Ms. Martin to adjourn the meeting at 9:10 P. M.
