ZONING BOARD OF APPEALS
REGULAR MEETING
DECEMBER 20, 2006

I.      CALL TO ORDER

James Daly, for Chairman Peter Stempien, called the regular meeting of the Zoning Board of Appeals to order at timeMinute34Hour197:34 p.m. in the Main Meeting Room of the Simsbury Town Offices. The following members were present: Joshua Storm, Katie Martin, James Dally and Craig MacCormac. Also in attendance were Howard Beach, Zoning Compliance Officer and other interested parties.

II.     APPOINTMENT OF ALTERNATES

Chairman Daly appointed Ms. Martin to serve as Secretary for this meeting and Mr. MacCormac to serve for Mr. Cosgrove.

Ms. Martin read the Call.

III.    PUBLIC HEARING(S), DISCUSSION AND POSSIBLE VOTE

1.      06-22   Application of Keri Hooper, Owner, requesting a Side Yard Variance to replace a deck, pursuant to Article 8, Section A of the Simsbury Zoning Regulations on property located at 17 Mountain Road. R-15 Zone

Keri Hooper, Owner, spoke on behalf of this application. She said that this house burned 20 years ago. Mr. Beach explained that a variance had been previously sought and granted to allow the reconstruction of the house, but the owner, as an oversight, neglected to ask for a 3-foot variance for the deck assuming it was part of the house structure. The deck has now collapsed and they want to rebuild it. Chairman Daly went back over the minutes from that meeting which did not mention the deck. Ms. Hooper said that without a deck they have no way to get out of the back door of their home, which is a safety issue. Mr. Beach explained that the lot is too narrow for this house as the lot is only 55-feet wide. It is a non-conforming lot. It would be physically impossible to have this house fitted legally situated on the lot.

Chairman Daly asked Ms. Hooper if she has received any feedback from her neighbors. Ms. Hooper said that she received only positive feedback. Chairman Daly opened the public hearing to public comment. As no else wanted to make any comments, Mr. Storm moved to close the public hearing. Ms. Martin seconded the motion. The motion passed unanimously.

Mr. Storm moved to approve the application of Keri Hooper, Owner, requesting a 3-foot side yard variance to replace a deck as depicted on the plot plan and to be built to code, pursuant to Article 8, Section A of the Simsbury Zoning Regulations on property located addressStreeta17 Mountain Road. The hardship being the shape of the lot, and the safety issue of the egress to the house. The motion was seconded by Ms. Martin and passed unanimously.

Mr. Storm moved to approve the minutes of dateYear2006Day15Month11November 15, 2006. The motion was seconded by Ms. Martin and passed unanimously.

Mr. Storm moved to adjourn the meeting at 7:20 p.m. The motion was seconded by Ms. Martin and passed unanimously.
