ZONING BOARD OF APPEALS
REGULAR MEETING
MARCH 28, 2007
I. CALL TO ORDER
Acting Chairman Thomas Horan called the regular meeting of the Zoning Board of Appeals to order at 7:31 P. M. in the Main Meeting Room of Simsbury Town Hall. The following members were present: James Daley, Katie Martin, Andrew Rose, and Joshua Storm. Also present were Howard Beach, Zoning Enforcement Officer, Lisa Arakelian, Commission Clerk, and other interested parties.
II. APPOINTMENT OF ALTERNATES
Acting Chairman Horan appointed Andrew Rose to serve for Peter Stempien.
III. PUBLIC HEARING – DISCUSSION AND POSSIBLE VOTE
A. 07-04 Application of Wallace A. Musick, Owner, requesting a side yard variance to place a prefabricated shed, pursuant to Article 8, Section A of the Simsbury Zoning Regulations on property located at 55 Old Meadow Plain Road. R-40 Zone.
Wallace Musick explained that he has applied for a five-foot variance to place a shed on his property to store equipment. He stated that other locations are prohibitive because of the positioning of the well on the property, and the location of a fence, garage, and walkway. Mr. Musick also stated that several other homes in the area have similar shed structures.
The Board suggested and discussed several other alternatives for placement of the shed, including positioning the structure against the house, behind the existing fence, therefore locating the shed entirely within the building area and eliminating the need for a variance.
Acting Chairman Stempien opened the hearing to public comment; hearing none, Acting Chairman Horan closed the public hearing.
A motion was made by Mr. Storm to grant the variance, as requested, based on the fact that the applicant has made a good-faith effort to present his case to the Board. The motion was seconded by Mr. Daley. Four members were opposed to the motion. The motion failed.
IV. APPROVAL OF MINUTES
A. February 28, 2007
Ms. Martin made the following amendment to the February 28, 2007 meeting minutes:
The motion to approve the minutes of the January 24, 2007 meeting was made by Mr. George and seconded by Mr. Rose.

A motion was made by Ms. Martin to approve the minutes of the February 28, 2007 meeting, as amended. The motion was seconded by Mr. Rose, and unanimously carried.
V. ADJOURNMENT
A motion was made by Ms. Martin to adjourn the meeting at 8:27 P. M.
