SPECIAL MEETING
SEPTEMBER 24, 2003

CALL TO ORDER

Michael Bradley, Chairman, called the Special Meeting of the Simsbury Zoning Commission to order at 8:00 a.m. in the Main Meeting Room of the Simsbury Town Offices. The following members were present: Austin Barney, James Gallagher, Garrett Delehanty, Jr., Susan Gleason, Patricia Askham and Alternate Mary J. Morris. Also present were William Voelker, Director of Community Planning & Development, Lois Laczko, Commission Clerk and other interested parties.

PRESENTATION, DISCUSSION AND POSSIBLE VOTE

Application of David A. Richman, Owner, for Site Plan Approval for reconstruction on property at 730 Hopmeadow Street. (continued from September 15, 2003 meeting)

Chairman Bradley read the planning staff comments from their memo dated September 24, 2003, which noted the Design Review Board recommendation for approval with the following modifications. 1) remove all floodlights and room air-conditioning units, 2) retain the existing birch tree cluster in the southwest corner, 3) lower lighting fixtures to the decorative blocks on the front of the building and change style to be compatible with the carriage style streetlights, 4) utilize parking lot lighting that is compatible in both style and color with the Simsbury style streetlights. Light source should be medal halite, 5) the deck structure should have screening in the form of lattice work underneath, 6) the space between the deck and the parking area should be landscaped with flowering evergreen type material such as PJM rhododendron and 7) the stairs at the two primary entrances should be widened to the width of the canopy.

Mr. Richman said explained that it would be difficult to get central air up to the third floor of the Victorian house. He said that there currently are two existing small window units and that they could move them to the north side where they would not be visible from any location. Mr. Richman said that it could be difficult to get lines up to service the third floor.

Commissioner Delehanty moved to approve with the recommendations of the Design Review Board, but affording the applicant the flexibility on the third floor of the Victorian to minimize the visibility of the air conditioning units as it needs to be done, the application of David A. Richman, Owner, for Site Plan Approval for reconstruction on property at 730 Hopmeadow Street. The motion was seconded by Commissioner Askham and passed unanimously.

b.      Application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC Agents for Text Amendments to regulate the operation of a multi-use sports complex in the B-1, B-2 and B-3 zones. (continued from September 15, 2003 meeting).

The commissioners discussed the letter received from the Town Attorney. Chairman Bradley said that the Town Attorney is saying that the commission can act on this application without regards to any pending lien on this property.

Commissioner Barney said that this is a positive potential use, but expressed two concerns. 1) it is unfortunate that it on this site, because it is not the ideal use for this site, and 2) reservations that the applicants are going to get the financing they purport. Commissioner Barney said that it is to the publics’ interest to support this application, so he will vote for it.

Chairman Bradley said that he has financing concerns, but feels that the applicants have a wonderful idea and a great dream. He will support it.

Commissioner Delehanty said that he would vote in favor of the application. He feels that this will be a great asset to the town, but also takes comfort in the ability to retrofit the building so it would not become a white elephant to the town.

Commissioner Gallagher said that he hopes that it works for the applicants and wished them luck. He will vote for the application.

Commissioner Gleason said that it is a wonderful project and she will vote for it.

Commissioner Askham said that she would support the application. She felt that the applicants had done a thorough job in looking into this and wished them well.

Commissioner Gallagher moved to approve the application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for Text Amendments to regulate the operation of multi-use sports complex in the B-1, B-2 and B-3 zones. The motion was seconded by Commissioner Askham and passed unanimously. The reason for approval is the recommendation of the Planning Commission noting the consistency of the Plan of Development particularly in the plan of economic policy.

Application April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for a Zone Change from R-40 to B-1 on property at St. John’s Place and Tariffville Road (lots 15A, 16A & 17).

Commissioner Gallagher moved to approve the application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for a Zone Change from R-40 to B-1 on property at St. John’s Place and Tariffville Road (lots 15A, 16A & 17). The motion was seconded by Commissioner Barney and passed unanimously. The reason for approval was that this was found to be consistent with the Plan of Development.

Application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for a Special Permit for a height modification, pursuant to amended Article Eight of the Simsbury Zoning Regulations on property at St. John’s Place and Tariffville Road (lots 15A, 16A & 17).

Commissioner Gallagher moved to approve the application of application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for a Special Permit for a height modification, pursuant to amended Article Eight of the Simsbury Zoning Regulations on property at St. John’s Place and Tariffville Road (lots 15A, 16A & 17). The motion was seconded by Commissioner Barney and passed unanimously. The reason for approval was as noted on the field trip and an examination was made in the Fire Department’s presence that the height would not unduly restrict the immediate surrounding properties and the public health, safety and welfare is not compromised.

Commissioner Askham moved to approve the application of April Pozzato, Owner, Kenneth Hyne and Scott Mintz, SportsPlus, LLC, Agents, for a Special Permit for a multi-use sports, recreational and restaurant complex, pursuant to amended Article 7, Section E,6 of the Simsbury Zoning Regulations on property at St. John’s Place and Tariffville Road (lots 15A, 15A & 17). The motion was seconded by Commissioner Barney and passed unanimously. The reason for approval was the need for the facility as this a very sports oriented community.
