CONSERVATION COMMISSION/INLAND WETLANDS SPECIAL MEETING
WENESDAY, MARCH 18, 2020
SIMSBURY TOWN OFFICES - MAIN MEETING ROOM - 7:30 p.m.

I. CALL TO ORDER – Margery Winters called the meeting to order at 7:30 p.m.

II. ROLE CALL
1. Appointment of Alternates – Mrs. Winters appointed Mr. Halderman to serve for a vacancy at 7:30 P.M.

1. Applications
A. Application #20-01 of Thomas Tyburski, Applicant; Town of Simsbury, Owner, to construct a permanent fence to replace the snow fence from circle garden to bandshell at Simsbury Meadows on the property located at 22 Iron Horse Boulevard. (Assessor’s Map H09, Block 226, Lot 003A). Zone SCZ
Thomas Tyburski representing the Town of Simsbury Parks and Recreation Department was present to speak to the application. Mr. Tyburski stated that the Town would like to replace the temporary snow fencing that is currently used to funnel attendees to the Performing Arts Center, with a decorative black metal fence. The installation would consist of digging holes to a distance below the frost line and cementing in the posts and top dressing with the native material. Any access material would be removed offsite by the contractor. Commissioner Morrison stated while this was a very simple project located in the upland review area with no direct wetlands impact, he wondered why the application was missing some key information that is noted as part of an application. Mr. Tyburski stated that he was very new to the process and was not aware of the need for that information. At this point the commission decided to entertain a motion.
Mr. McCusker moved that this is a regulated activity because it falls in the upland review area. Mr. Levy seconded the vote was 6-0-1 with Mr. Campolieta abstaining.
Mr. McCusker moved that it is not a significant activity. Mr. Levy seconded the vote was 6-0-1 with Mr. Campolieta abstaining.
Mr. McCusker made a motion to approve application #20-01 installation of a fence in the upland review. Mr. Levy seconded, the vote was 6-0-1 with Mr. Campolieta abstaining.

B. Application #20-02 of Anita S. Miller, Applicant/Owner; to construct a shed on
the property located at 49 Ichabod Road. (Assessor’s Map C18, Block 601, Lot
038). Zone R-25
Mrs. Miller was asking for an approval to install a 96 square foot shed in the upland review area. Agent Hazel stated that he made a site visit to discuss the best location for the shed. He noted that two locations posed the least amount of disturbance in order to place the shed. Mrs. Miller stated that it would be on a gravel base.
Mr. Levy moved that this is a regulated activity because it falls in the upland review area. Mr. McCusker seconded the vote was unanimous.

Mr. Levy made a motion to delegate the to the agent for approval application #20-02 installation of a shed on a gravel base in the upland review. Mr. McCusker seconded, the vote was unanimous.

2. Determination
The agent asked the commission for a determination on 21 Country Club Road, constriction of a new single family home. The lot is very steep with a ravine. The site plan showed a proposed pipe at the bottom of the ravine and as the agent Mr. Hazel questioned the need. Upon further review and a site visit two things became relatively clear. The pipe was needed because of the amount of fill needed to grade the lot and a pipe would be needed to continue to allow the ravine to have flow. That created the question of whether this was an intermittent stream or not. Upon inspection during a rain event no flow was present. The leaves did not show scour or staining and there was no wetlands vegetation present. The soils are Hinckley loamy sand which is excessively drained. The agent concluded that it was not an intermittent stream and is asking if the commission agrees with this interpretation. The commission agreed with the agent and told him to allow the project to move forward with no need for approval.

VI. CONSERVATION COMMISSION DUTY WORK
1. Mr. Levy made a motion to table the work as presented on the agenda. Mr. McCusker seconded, the vote was unanimous.
VII. ADJOURNMENT
Mr. Levy made a motion to adjourn the special meeting. Motion was seconded by Mr. McCusker and motion passed unanimously at 8:00 p.m.
