Board of Finance Regular Meeting minutes-4/8/15

1.   Call to Order

Mr. Askham, Chairman, called the Regular Meeting of the Board of Finance to order at 7:41 P.M. on Wednesday, April 8, 2015 in the Amphitheatre at Simsbury High School, 34 Farms Village Road, Simsbury, Connecticut. 

The following members were also present:  Nicholas Mason, Barbara Petitjean, Linda Schofield, Jeff Blumenthal and Moira Wertheimer. 

2.  Discussion and possible action regarding Operating and Capital Budgets

Ms. Petitjean made a motion to approve the 2015-2016 Board of Selectmen Operating Budget in the amount of $18,867,969.  Mr. Blumenthal seconded the motion, all were in favor and the motion passed.

Ms. Wertheimer made a motion to approve the 2015-2016 Board of Education Operating Budget in the amount of $66,453,005.  Ms. Petitjean seconded the motion, all were in favor and the motion passed.

Ms. Petitjean made a motion to approve the 2015-2016 Non-Public School Operating Budget in the Amount of $537,737.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

Ms. Petitjean made a motion to approve the 2015-2016 Debt Retirement Operating / Capital Budget in the Amount of $6,166,819.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

Ms. Petitjean made a motion to approve the 2015-2016 Capital Non-Recurring Fund Budget in the Amount of $1,225,013.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

Ms. Petitjean made a motion to approve the 2015-2016 Sewer Use Operating Budget in the Amount of $3,395,564.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

Ms. Petitjean made a motion to approve the 2015-2016 Residential Rental Properties Operating Budget in the Amount of $41,320.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

Ms. Petitjean made a motion to approve the 2015-2016 Simsbury Farms Fund Operating Budget in the Amount of $1,891,200.  Mr. Blumenthal seconded the motion which was approved by ­6 votes in favor and 0 votes opposed.

 

Ms. Wertheimer made the following resolution:

Pursuant to Section 808 of the Town Charter the following motions were introduced at the Regular Meeting of the Board of Finance on April 8, 2015:

Be it resolved, that the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of the Board of Selectmen annual budget for the fiscal year ending June 30, 2016, shall be approved and implemented in the amount of $18,867,969.

Be it resolved, that the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of the Board of Education annual budget for the fiscal year ending June 30, 2016, shall be approved and implemented in the amount of $66,453,005.

Be it resolved, that the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of Sewer Use Fund (Sewer Treatment Plant), Residential Rental Properties, Simsbury Farms/Special Programs, Non-Public Schools, Debt Retirement/Capital and Capital Non-Recurring annual budgets for the fiscal year ending June 30, 2016, shall be approved and implemented in the amount of $13,257,653.

In Accordance with Sections 406 (Automatic Referendum) and 808 (Duties of the Board of Finance on the budget) of the Charter, the recommended operating budgets will be submitted to a referendum in the following forms:

Questions for Referendum Ballot:

1. Shall the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of the Board of Selectmen annual budget for the fiscal year ending June 30, 2016, be approved and implemented in the amount of $18,867,969?

2. Shall the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of the Board of Education annual budget for the fiscal year ending June 30, 2016, be approved and implemented in the amount of $66,453,005?

3. Shall the appropriation recommended and approved by the Board of Finance for the purposes of paying the expenses of Sewer Use Fund(Sewer Treatment Plant), Residential Rental Properties, Simsbury Farms/Special Programs, Non-Public Schools, Debt Retirement  / Capital and Capital Non-Recurring annual budgets for the fiscal year ending June 30, 2016,  be approved and implemented in the amount of $13,257,653?

Ms. Petitjean seconded the resolution which was approved by 6 votes in favor and 0 votes opposed.

 

Ms. Petijean made a motion to have the Board of Selectman combine the $1,100,000 Simsbury Farms Improvement capital item with the $508,000 Parks improvement into one referendum question. Seconded by Ms. Wertheimer.

The resolution failed by 1 vote in favor and 5 votes opposed.

 

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate ONE MILLION ONE HUNDRED THOUSAND DOLLARS ($1,100,000) for improvements to the Simsbury Farms including, improvements to the skating rink (creation of an enclosed seating areas, sanding and painting, and upgrades to the refrigeration system) and the pool area (main pool: replacement of gutter system, anchors and deck equipment and installation of new shotcrete walls, drains and surge tank; dive pool: installation of new tile, coping and wall coating; training pool: installation of new tile and wall coating; filter room: replacement of all valves, flow meters, controllers and chemical pumps).  The appropriation may be spent for design, construction, acquisition and installation costs, right-of-way acquisition, materials, administrative, testing, engineering fees, consultant and legal fees, related improvements, repairs or renovations, net interest on borrowings and other financing costs, and other expenses related to the project.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $1,100,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal: 

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate FIVE HUNDRED EIGHT THOUSAND DOLLARS ($508,000) for improvements to various Town parks including replacement of playground equipment and resurfacing, reconstruction of the Tariffville Park pavilion, resurfacing of  the tennis courts at Simsbury Farms and Tariffville Park, installation of lightening protection systems at Simsbury Farms and Memorial Park, wading pool reconstruction and building improvements to at Memorial Pool, and construction of a new basketball court at Simsbury Farms, and related work.  The appropriation may be spent for design, engineering, and other consultants’ fees, site work, construction and equipment costs, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $508,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate ONE HUNDRED FORTY-FIVE THOUSAND DOLLARS ($145,000) for open space planning, design and construction, including an inventory and evaluation of all

Town owned open space, construction of parking improvements, wayfinding signage, trail improvements, culvert and bridge replacement, interpretive educational signage, and entrance signage, and related work.  The appropriation may be spent for design and construction costs, survey fees, site work, equipment, materials, furnishings and supplies, architects', engineering and other consultants’ fees,  legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.   The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $145,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:                                 

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate FIFTY-SEVEN THOUSAND DOLLARS ($57,000) for planning and code preparation work for Route 10 in the Weatogue area, from Route 185 to Powder Forest Drive.  The appropriation may be spent for planning, design, permitting, testing, engineering fees, consultant and legal fees, net interest on borrowings and other financing costs, and other expenses related to the project.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $57,000 to finance the appropriation.

The resolution was approved by 5 votes in favor and 1 votes opposed (Petitjean).

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate THREE HUNDRED SEVENTY-FIVE THOUSAND DOLLARS ($375,000) for replacement of the Highway Salt Shed on Town Forest Road. The appropriation may be spent for design and construction costs, materials, easement acquisition, site improvements, material testings, survey fees, engineering fees, legal fees, net interest on borrowings and other financing costs, and other expenses related to the project or its financing.   The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $375,000 to finance the appropriation.

The resolution was approved by 6 votes in favor and 0 votes opposed.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate FIFTY THOUSAND DOLLARS ($50,000) for planning and design of renovations to the Simsbury Municipal Building, including evaluation of space needs.  The appropriation may be spent for planning, design, engineering and other consultants’ fees, equipment costs, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $50,000 to finance the appropriation.

The resolution was approved by 5 votes in favor and 1 votes opposed (Petitjean).

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate THIRTY THOUSAND DOLLARS ($30,000) for dam inspection, evaluation and repairs of the five (5) Town owned dams: Town Forest Road Dam, Stoddard Reservoir Dam, Library Lane dam, Simsbury Farms Pond Dam and Lake Basile Dam. The appropriation may be spent for design, engineering, and other consultants’ fees, construction costs, equipment costs, legal fees, utility fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $30,000 to finance the appropriation.

The resolution was approved by 5 votes in favor and 1 votes opposed (Petitjean).

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

            RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate TWO HUNDRED EIGHTY THOUSAND DOLLARS ($280,000) for Public Works Complex infrastructure improvements, including: (1) installation of a permanent lift station to serve for the disposal of sanitary sewer and wash water from the truck wash facility; (2) installation of a sanitary sewer force main to connect to the existing sewage pumping station on Long View Drive; (3) replacement of the existing water service to the complex to provide additional supply for the Truck Wash Facility; (4) installation of replacement unit heaters in the Vehicle Maintenance Garage to support conversion to natural gas fuel for heating; (5) improvements to storm drainage system serving the facility for compliance with current stormwater permit requirements; (6) security gate replacement for the access to the complex; (7) electrical upgrades and installation of existing emergency generator; (8) roof replacement for maintenance building; (9) installation of emergency sprinkler system in maintenance building; (10) expansion of administrative space for multipurpose use including shared workstations, training room and temporary bunk space/storage. The appropriation may be spent for design, engineering and other consultants’ fees, equipment costs, construction, costs, materials, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified  project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $280,000 to finance the appropriation.

Ms. Wertheimer  introduced the following resolution, which was seconded by Mr. Blumenthal: 

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate FORTY-FIVE THOUSAND DOLLARS ($45,000) Town Hall site and safety improvements, including: (1) improvement in vehicular access and safety to State Route 10/202; (2) improvements in pedestrian crossing for State Route 10/202; (3) expansion of storage and security for Police Department in rear parking area; (4) replacement and relocation of Maintenance Garage; (5) sidewalk, curbing and paver repair and replacement; (6) flagpole installation; and (7) landscaping improvements; and other related improvements.  The appropriation may be spent for design, construction, equipment, furnishings, materials, legal fees, net interest on borrowings and other financing costs, and other expenses related to the project or its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $45,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate EIGHTY THOUSAND DOLLARS ($80,000) for acquisition of a portable generator and generator infrastructure work, including (1) purchase of a trailer mounted 250 kW portable standby generator to provide a portable source of standby power for all Town buildings and for use by the Water Pollution Control Authority, (2) electrical work to complete the retrofitting of the electrical system at Eno Memorial Hall, Simsbury Public Library, and Town Hall to accommodate connections to the portable generator, and (3) relocation of the existing 100 kW generator serving the Public Works complex to serve the Parks Maintenance Facility.  The appropriation may be spent for design and engineering services, acquisition and installation costs, testing, equipment, materials, site improvements, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $80,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:  

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate TWENTY-EIGHT THOUSAND DOLLARS ($28,000) for a Capital Planning Fund for preliminary engineering and planning services required for capital projects.  Such fund shall be used for professional services for the establishment of project scope, preliminary cost estimates, land surveys, environmental reviews, permit evaluations and conceptual studies.  The appropriation may be spent for planning, design, environmental review, architectural services, engineering, inspection and other consultant fees, administrative costs, legal fees, net interest on borrowings and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $28,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:      

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate ONE HUNDRED SEVENTY-FIVE THOUSAND DOLLARS ($175,000) for various drainage improvements projects, including drainage improvements and cross culverts to improve drainage and the safety of the roadway network along East Weatogue Street, Westledge Road, Hoskins Road, Canal Street, and Tariffville Heights, and related work, following a review by the Planning and Zoning Commission pursuant to Section 8-24 of the Connecticut General Statutes, Revision of 1958, as amended. The appropriation may be spent for design and construction costs, equipment, materials, site improvements, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Selectmen may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $175,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

            RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate from the Sewer Use Fund THREE HUNDRED SEVENTY-ONE THOUSAND DOLLARS ($371,000) for costs in connection with the extension of sewers to areas where residents have requested sewer service due to septic system failure and lack of sufficient lot size to construct a new system that adheres to Health Code, anticipated to include portions of the Munnisunk Drive neighborhood, following a public hearing by the Water Pollution Control Authority pursuant to Section 7-247a of the Connecticut General Statutes, Revision of 1958, as amended and a review by the Planning and Zoning Commission pursuant to Section 8-24 of the Connecticut General Statutes, Revision of 1958, as amended.  The appropriation may be spent for design, construction and installation costs, equipment, materials, engineering, inspection and consultant fees, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate from the Sewer Use Fund TWO HUNDRED SIXTY  THOUSAND DOLLARS ($260,000) for replacement of an inline grinder and screen replacement unit at the wastewater treatment facility.  The appropriation may be spent for design, installation costs, equipment, materials, engineering, inspection and consultant fees, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

                                  

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate from the Sewer Use Fund ONE HUNDRED THIRTY_FIVE THOUSAND DOLLARS ($135,000) for costs in connection with the repair, though relining, pipe bursting/inserts, and relocation of sewers in Hopmeadow Center, including a TV inspection of the existing sewer to identify needed repairs and replacements.  The appropriation may be spent for testing, investigation and evaluation costs, equipment, materials, engineering, inspection and consultant fees, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate from the Sewer Use Fund FIFTY THOUSAND DOLLARS ($50,000) for planning and design of an interceptor sewer to serve the West Mountain Road area.  The appropriation may be spent for design, engineering, inspection and consultant fees, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

            RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate EIGHTY THOUSAND DOLLARS ($80,000) from the Sewer Use Fund an aggregate appropriation of EIGHTY THOUSAND DOLLARS ($80,000) for the acquisition of a trailer mounted 250 kW portable standby generator to provide a portable source of standby power for all town buildings and for use by the Water Pollution Control Authority.  The appropriation may be spent for acquisition and installation costs, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

            RESOLVED, that the Board of Finance recommends that the Town of Simsbury appropriate from the Sewer Use Fund SEVENTY-TWO THOUSAND DOLLARS (72,000) for the acquisition of a trailer mounted six (6) inch standby dri-prime pump with associated suction and discharge piping to provide the capability to bypass pump sewage at all of the existing Town sewer pump stations.  The appropriation may be spent for acquisition and installation costs, administrative costs, legal fees, and other expenses related to the project.  The Water Pollution Control Authority may determine the particulars, and may reduce or modify the scope of the project, and the entire appropriation may be spent on the reduced or modified project.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate TWO HUNDRED THOUSAND DOLLARS ($200,000) for design, acquisition and installation of a school district-owned network infrastructure to replace aging equipment.  The appropriation may be spent for design, engineering and other consultants’ fees, equipment costs, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Education may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified  project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $200,000 to finance the appropriation.

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate TWO MILLION ONE HUNDRED FIFTY THOUSAND DOLLARS ($2,150,000) for design, acquisition and installation of a climate control improvements to school facilities.  The appropriation may be spent for design, engineering and other consultants’ fees, equipment costs, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Education may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified  project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $2,150,000 to finance the appropriation.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED that the Board of Finance recommends that the Town of Simsbury appropriate SEVEN HUNDRED SEVENTY THOUSAND DOLLARS ($770,000) for roof replacement at the Central School.  The appropriation may be spent for design, engineering and other consultants’ fees, construction, equipment costs, legal fees, net temporary interest and other financing costs, and other expenses related to the project and its financing.  The Board of Education may determine the particulars, and may reduce or modify the scope, of the project, and the entire appropriation may be spent on the reduced or modified project; and that the Town issue bonds or notes and temporary notes in an amount not to exceed $770,000 to finance the appropriation.

The resolution was approved by 6 votes in favor and 0 votes opposed.

Ms. Wertheimer introduced the following resolution, which was seconded by Mr. Blumenthal:

RESOLVED, that the Board of Finance of the Town of Simsbury recommends (1) that any bonds issued to implement the various capital improvement projects recommended at this meeting be issued for a term not to exceed ten years, (2) that the maximum term of any bonds issued to refund any bond anticipation notes be reduced by the period of time that bond anticipation notes are outstanding in excess of two years, and (3) that the Town retire any such notes which are outstanding in excess of two years in an amount equal to at least 1/10, as applicable, of such notes no later than three years from the date of initial note borrowing and again no later than four years from the date of initial note borrowing.

The resolution was approved by 6 votes in favor and 0 votes opposed.

 

3.  Discussion and possible actions on future meetings

Ms. Wertheimer made a motion to adjourn the meeting.  Mr. Blumenthal seconded the motion and the motion passed.  The meeting was adjourned at 8:25 p.m.
