CONSERVATION COMMISSION/INLAND WETLANDS AND WATERCOURSES AGENCY

 

REGULAR MEETING June 6, 2023, 7:30 P.M. HELD MAIN MEETING ROOM SIMSBURY TOWN HALL

 

  1. CALL TO ORDER & ROLL CALL

 

Chairman Winters calls the meeting to order at 7:30 P.M.

 

Present: Director of Community Planning and Development, George McGregor, Assistant Director of Planning and Development, Brittany MacGilpin, Jason Berman, Donald Eaton, Charles Haldeman, Kyle Testerman (Alternate), Cailyn Welsh (Alternate), Margery Winters

 

Absent: Andrew Bade, Joseph Campolieta, Jason Levy

 

Kyle Testerman and Cailyn Welsh are seated as full members in Dr. Bade’s and Mr. Levy’s absences.

 

  1. APPROVAL OF MINUTES

 

May 16, 2023

 

Motion:  Without objection, Ms. Winters moves to approve the May 16, 2023 minutes for the regular meeting of the Conservation Commission/Inland Wetlands and Watercourses Committee. 

 

All in favor, no opposed, no abstentions. (6-0-0)

 

  1. NEW APPLICATIONS FOR RECEIPT AND DETERMINATION OF SIGNIFICANCE

 

Application CC#23-21 of Rourk and Hannah Marlow, Owners, for a wetland permit to construction a +/- 465 sq. ft. inground pool in the upland review area at 25 Orchard Lane, (Assessor’s Map D16, Block 419, Lot 034) Simsbury, CT 06070, zone R-40.

  • Ms. MacGilpin presents an overview of the project, noting that state statute requires a public hearing for the map amendment to the wetland area, which Town Staff recommends be scheduled for the regular meeting of the Commission on July 18, 2023.
  • Ms. Winters recommends utilizing native plants during if the Owners will be landscaping.  Mr. Marlow, Owner, responds that native plants will be utilized in landscaping plans.

 

Motion:  Mr. Haldeman moves to find Application CC#23-21 of Rourk and Hannah Marlow, Owners, for a wetland permit to construct a +/- 465 sq. ft. inground pool in the upland review area at 25 Orchard Lane, (Assessor’s Map D16, Block 419, Lot 034) Simsbury, CT 06070, zone R-40 to be a non-significant activity and schedules it for action at the regular meeting of the Committee on July 18, 2023.  Mr. Berman seconds.  

 

All in favor, no opposed, no abstentions. (6-0-0)

 

Motion: Mr. Haldeman moves to schedule the map amendment associated with Application CC#23-21 for public hearing at the regular meeting of the Committee on July 18, 2023.  Ms. Welch seconds.

Application CC#23-25 of Todd and Andrea Burrick, Owners, LADA, P.C. Land Planners, Applicant, for a wetland permit to construct a +/- 321 sq. ft. deck in the upland review area at 4 Victoria Lane, (Assessor’s Map C08, Block 212, Lot 010) Simsbury, CT 06070, zone R-40.

  • Ms. Winters inquires if there will be any planting or landscaping.  Ms. Burrick, Applicant, responds that there will be no plantings.
  • Mr. Berman inquires how close deck will be to the septic.  Ms. Burrick responds that the deck will be the same distance to the septic as it currently is.

 

Motion:  Mr. Haldeman moves to find Application CC#23-25 of Todd and Andrea Burrick, Owners, LADA, P.C. Land Planners, Applicant, for a wetland permit to construct a +/- 321 sq. ft. deck in the upland review area at 4 Victoria Lane, (Assessor’s Map C08, Block 212, Lot 010) Simsbury, CT 06070, zone R-to be a non-significant activity and schedules it for action at the next regular meeting of the Committee on June 20, 2023.  Mr. Berman seconds.

  1. PUBLIC HEARING AND/OR PUBLIC ACTION ON APPLICATIONS

 

Application CC#23-19 of Frank and Catharine Joslyn, Owners, for a wetland permit to construct a +/- 572 sq. ft. addition in the upland review area at 20 Saddle Ridge Drive, (Assessor’s Map C07, Block 212, lot 031) Simsbury, CT 06070, Zone R-80.

  • Ms. Winters inquires if there is any plan for landscaping.  Ms. Joslyn, Owner, responds that there are no current plans, but will ensure to include native plantings once plans are developed.  She also confirms that any invasive species will be removed to the extent possible.
  • As the Owners have not hired a contractor and there is no final development plan, Mr. Haldeman suggests delaying ruling until a plan is finalized.  Mr. Joslyn, Owner, confirms agreement and expects to have a contractor hired within the week. 

 

Motion:  Mr. Haldeman motions to move ruling on Application CC#23-19 of Frank and Catharine Joslyn, Owners, for a wetland permit to construct a +/- 572 sq. ft. addition in the upland review area at 20 Saddle Ridge Drive, (Assessor’s Map C07, Block 212, lot 031) Simsbury, CT 06070, Zone R-80., to next regular meeting of the Committee on June 20, 2023.  Mr. Berman seconds.

Application CC#23-20 of Karie Devita & Larry Severance, Owners, Frank VanLinter, Applicant, for a wetland permit to construct a +/- 615 sq. ft. addition, a portion of which will replace an existing deck and patio in the upland review area at 24 Banks Road, (Assessor’s Map E12, Block 127, Lot 025) Simsbury, CT 06070, Zone R-40OS.

  • Ms. Winters recommends utilizing native plants in landscaping plans.  Ms. Devita, Owner, confirms native plantings will be utilized in landscaping plans.

 

Motion:  Mr. Haldeman moves to approve Application CC#23-20 of Karie Devita & Larry Severance, Owners, Frank VanLinter, Applicant, for a wetland permit to construct a +/- 615 sq. ft. addition, a portion of which will replace an existing deck and patio in the upland review area at 24 Banks Road, (Assessor’s Map E12, Block 127, Lot 025) Simsbury, CT 06070, Zone R-40OS, based upon the following findings:

 

  1. The project will not adversely impact the wetlands.

 

And subject to the following conditions:

 

  1. The project shall be developed in substantial conformance with the survey titled, “Exhibit A”, submitted for 24 Banks Road, prepared by W.E. Peters, dated August 22, 1973.
  2. Native plantings will be replanted and invasive plant species removed to the greatest extent possible on the property.
  3. At all times during site work and until soil areas are stabilized, the applicant shall install and maintain erosion and sediment control measures depicted in the application or other measures deemed necessary by the Commission’s agent to prevent erosion and sedimentation impacts to the watercourse.
  4. All erosion control and soil stabilization measures shall comply with the approved plans and the guidelines as established in the Connecticut Guidelines for Soil Erosion and Sediment Control, 2002, CTDEP Bulletin 34.
  5. Upon direction of the Commission’s agent, erosion and sediment control measures shall be removed by the applicant following stabilization of the site.
  6. The Inland Wetlands Agent shall be notified at least 48 hours prior to commencement of activities.

  1. GENERAL COMMISSION BUSINESS
  • Mr. McGregor updates the Commission on the prior Application CC#22-29 of Vessel RE Holdings, noting that a neighboring property owner is appealing the ruling of the Commission.  Town Staff will work with the Commission as needed during the appeal process.
  • Ms. Winters inquires if the Commission’s letter around utilization of experts was sent to the Board of Selectman.  Mr. McGregor confirmed that the letter is being sent prior to their meeting next week.  The item will also be an agenda item for the Zoning Commission’s consideration.

 

  1. AGENT ACTIONS

 

Application CC#23-18 of Deborah McDonald, Owner, for a wetland permit to install two LP tanks and a generator in the upland review area at 5 Riverview Circle, (Assessor’s Map G13, Block 144, Lot 005A) Simsbury, CT 06070, Zone RD.

  • Mr. Haldeman questions whether there are concerns around the area flooding.  Ms. MacGilpin responds that the Applicant moved the location, so it is no longer in the flood zone.

 

Application CC#23-22 of Maggie Siedel, Owner, James Karoutas, applicant, for a wetland permit to allow for one additional pier in the upland review area in order to increase an existing deck to a size of approximately 18’ x 26’ at 2 Pia Lane, (Assessor’s Map E05, Block 301, Lot 001) Simsbury, CT 06070, zone CZ.

 

Application CC#23-23 of Deitch Energy, LLC, Applicant, and Mandru Jeevan, Owner, for a wetland permit to install one LG Heat Pump Condenser in the upland review area at 4 Ichabod Road, (Assessor’s Map C18, Block 605, Lot 025) Simsbury, CT 06070, zone R-25.

 

Application CC#23-24 of Mandy Drumm, Applicant, Tim Dale, Owner, for a wetland permit to install a Bosch Heat Pump Condenser in the upland review area at 9 Washburn Drive, (Assessor’s Map F08, Block 147, Lot 014) Simsbury, CT 06070, zone R-40.

 

  1. CONSERVATION BUSINESS
  • Ms. Winters raises concerns with the process around the excavation of the Simsbury Farms pond and would like to better understand the process, which falls under the state permit for dams.  Mr. McGregor will work with Town Engineering to discuss process with the Commission.
  • Mr. Eaton inquires if the issue regarding the exposed fiberoptic cable on bike path was resolved.  Mr. McGregor will follow-up.
