ZONING BOARD OF APPEALS

Regular Meeting Minutes

May 23, 2018

I.             CALL TO ORDER

Chairman Katie Martin called the regular meeting of the Zoning Board of Appeals to order at 7:04 P.M. in the Main Meeting Room located at 933 Hopmeadow Street, Simsbury, CT.  The following members were also present Dennis Fallon, JoAnn Hogan, Diane Madigan, and Steven Antonio.  Also present were Robin Newton, Code Compliance Officer

 

 

II.            ROLL CALL

 

1.            Appointment of Alternates

 

Chairman Martin appointed Ms. Madigan to serve as Secretary.

 

 

III.           APPLICATIONS

 

Ms. Madigan read into the record the legal notice for the Town of Simsbury Zoning Board of Appeals regular meeting for May 23, 2018 that included the following applications:

 

1.            Public Hearings

Application #18-01 of Robert Long, owner, for variance to the side and rear yard setbacks pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations to accommodate the construction of a pool shed on the property located at 2 ½ Timber Ridge Drive (Assessor’s Map F06, block 306, Lot 029). Zone R-40OS.

 

Chairman Martin opened the public hearing.  The applicant, Bob Long, gave a presentation of what was being proposed and the hardships that caused him to request the variances for both the side and rear property boundary.  Mr. Long did state he had spoken with and obtained signatures from the neighbor directly impacted and the neighbor across the street.  Both abutters stated they had no objections to the variance requests being made.  Mr. Long added he was adding bushes along the property boundary with the direct abutter to minimize visual impacts. 

 

The Board asked questions regarding different possible placements of the shed.  The different areas were discussed individually with an explanation from the property owner as to why those placements would no work.

 

2.              Discussion and Possible Action

Application #18-01 of Robert Long, owner, for variance to the side and rear yard setbacks pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations to accommodate the construction of a pool shed on the property located at 2 ½ Timber Ridge Drive (Assessor’s Map F06, block 306, Lot 029). Zone R-40OS.

 

Chairman Martin closed the Public Hearing on Application #18-01.

 

Mr. Antonio made a motion to approve the variance request of a 7’ side yard variance and a 2’ rear yard variance with the following condition:  “This variance is granted in accordance to the variance setbacks approved on 5/23/18 and as shown on plans entitled, “Proposed Pool Shed, Property of Robert G. Long & Christine Winn, 2.5 Timber Ridge Drive, Simsbury, CT, Scale 1”=20’, Dated May 2, 2018, Prepared by Barresi Associates, LLC”.  The variance is limited to the structure as shown on the referenced plans. Any future additions or accessory structures would need to comply with the regulations.

 

                The Board is approving this variance for the following reasons as discussed:  the location of the wetlands and the irregular shape of the property.

 

The motion was seconded by Diane Madigan.

 

Board members voted 5(five) Yes and 0 (zero) No.  The motion has passed. 

 

 

IV.  GENERAL COMMISSION BUSINESS

 

None

 

V. APPROVAL OF MINUTES of December 20, 2017

                Mr. Fallon made a motion to approve the minutes for December 20, 2017 as written.

 

Steven Antonio seconded the motion to approve the minutes.  Motion carried 5-0.

 

 

VI.    ADJOURNMENT

 

                Mr. Fallon made a motion to adjourn the meeting at 7:20 p.m.  Mr. Antonio seconded the motion.  All were in favor and the motion passed.
