ZONING BOARD OF APPEALS

Regular Meeting Minutes

August 22, 2018

I.             CALL TO ORDER

Acting Chairman Dennis Fallon called the regular meeting of the Zoning Board of Appeals to order at 7:05 P.M. in the Main Meeting Room located at 933 Hopmeadow Street, Simsbury, CT.  The following members were present Dennis Fallon, JoAnn Hogan, Diane Madigan, and Steven Antonio.  Also present were Robin Newton, Code Compliance Officer.  Member Tom Horan arrived at 7:25 p.m.

 

Steven Antonio was appointed as acting Secretary for this meeting.

 

II.            ROLL CALL

None

 

III.           APPLICATIONS

 

Steven Antonio read into the record the legal notice for the Town of Simsbury Zoning Board of Appeals regular meeting for August 22, 2018 that included the following applications:

 

1.            Public Hearings

Application #18-03 of Chris and Debbie Stanhope, Owners, for a variance to the side yard setback pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations to accommodate the construction of a deck attached to an existing residence on the property located at 173 Hoskins Road (Assessor’s Map F05, Block 301, Lot 015), Zone R-40

 

Acting Chairman Fallon opened the public hearing.  The owner Chris Stanhope came forward to present the variance request to the Board.  Mr. Stanhope showed pictures to the Board showing the deck location in relations to the rear of the house.  The Board asked has some questions to the owner. 

 

There were no members of the public present to speak.

2.              Discussion and Possible Action

 

Diane Madigan made a motion to approve the variance request with the following condition, “This variance is granted in accordance to the variance setbacks approved on 8/22/18 and as shown on plans entitled, “Sanderson & Washburn, survey- Stanhope/Tinney, 173 Hoskins Road, Simsbury, Conn, Dated 9/26/85” .  The variance is limited to the structure as sketched on the referenced plans. Any future additions or accessory structures would need to comply with the regulations.  Steven Antonio seconded the motion.  The Board discussed the reasons for granting the request which included the fact that the house was built in 1909.  There was an existing deck there as shown on the survey and this was a minor extension of the non-conforming part of the previous deck.  There are no neighbors on the side of the property being effective by the variance request.  Acting Chairman Fallon asked for a vote.  The motion was carried unanimously.  4-0.

 

IV.  GENERAL COMMISSION BUSINESS

 

Board member Tom Horan arrived at 7:25 p.m.   Code Compliance Officer Newton informed the Board that the Zoning Commission is currently updating their regulations and she would like feedback regarding any variance request they have seen multiple times in the past that would be advantageous for the Zoning Commission to review.  The Board indicated A/C condensers, generators, front porches/porticos, two front yards on corner lots.

 

V. APPROVAL OF MINUTES June 26, 2018

Steven Antonio made a motion to approve the minutes of June 26, 2018.  The motion was seconded by Tom Horan.  Motion to accept the minutes as written were approved unanimously 5-0.

 

VI.    ADJOURNMENT

 

                Mr. Horan made a motion to adjourn the meeting at 7:45 p.m.  Mr. Antonio seconded the motion.  All were in favor and the motion passed.
