ZONING BOARD OF APPEALS
REGULAR MEETING
May 22, 2013

I. CALL TO ORDER

Chairman Tegan Blackburn called the regular meeting of the Zoning Board of Appeals to order at 7:00 P. M. in the Main Meeting Room at Simsbury Town Hall.  The following members were also present:  Carol Bingham, Paul Cocchi, Dennis Fallon, Thomas Horan, Katie Martin, and Greg Piecuch.  Jacqueline Battos arrived at 7:03 P. M.  Also present were Lynn Charest, Zoning Compliance Officer; Lisa Gray, Commission Clerk; and other interested parties. 

II. APPOINTMENT OF ALTERNATES

Chairman Blackburn appointed Paul Cocchi to serve for Craig MacCormac.

III. PUBLIC HEARINGS

A. 13-04 – Application of Keith and Jennifer Anderson, Owners, for a side yard variance to accommodate the placement of a shed, pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations, on property located at 5 Shady Lane (Map D10, Block 147, Lot 102).  R-40 Zone.

Keith Anderson explained that he is seeking a 10-foot side yard variance to place a 10 x 12’ shed.  He distributed photographs and explained that the proposed location is the only feasible one because of the lot’s topography, location of the septic system, and the existence of wetlands on the property.

Chairman Blackburn noted that it appeared that the applicant based the requested variance on the distance of the shed from the property line instead of the setback line and that the actual variance being requested should be 30 feet.  She also asked Mr. Anderson if it would be possible to move the shed any closer to the house.  Mr. Anderson replied that he could move it three to five feet closer. 

Chairman Blackburn opened the hearing to public comment and read letters in favor of the application from Charles and Margitta Dahlberg, 24 Fox Den Road; Jerry Barcikowski, 26 Fox Den Road; and Marian Ricker, 4 Shady Lane.

A motion was made by Mr. Horan to close the public hearing.  The motion was seconded by Mr. Piecuch, and unanimously carried.

A motion was made by Mr. Piecuch to grant a 25-foot side yard variance, based on the topography of the property.  The motion was seconded by Ms. Martin, and unanimously carried.

B. 13-05 – Application of Robin Verrone and Scott Jobeless, Owners, for a side yard variance to accommodate the placement of an above-ground pool, pursuant to Article Eight, Section A, or the Simsbury Zoning Regulations, on property located at 33 Deerfield Lane (Map E14, Block 114, Lot 11).  R-40 Zone.

Robin Verrone explained that she is seeking a 20-foot side yard variance to place an above-ground pool behind the home.  She claimed her hardship to be the non-conforming size of the lot, the placement of the home on the lot, and safety concerns of her children.

There was some confusion over the actual size of the variance needed.  It was agreed that a 15-foot variance would be sufficient.

Chairman Blackburn opened the hearing to public comment and read letters in favor of the application from John and Alison Riley, 31 Deerfield Lane; Leanne Cusack and Jeffrey Bowers, 34 Deerfield Lane; and Tim and Allison Sullivan, 36 Deerfield Lane.

A motion was made by Ms. Martin to close the public hearing.  The motion was seconded by Mr. Piecuch, and unanimously carried. 

A motion was made by Ms. Martin to approve a 15-foot side yard variance, based on the non-conforming status of the property and safety concerns.  The motion was seconded by Ms. Bingham, and unanimously carried.

IV. MINUTES

A. November 28, 2012

A motion was made by Ms. Martin to approve the minutes of the November 28, 2012 meeting, as presented.  The motion was seconded by Mr. Cocchi, and unanimously carried.

B. April 24, 2013

A motion was made by Mr. Piecuch to approve the minutes of the April 24, 2013 meeting, as presented.  The motion was seconded by Ms. Bingham, and unanimously carried.

V. ADJOURNMENT

A motion was made by Ms. Bingham to adjourn the meeting at 7:56 P. M.
