ZONING BOARD OF APPEALS

Regular Meeting Minutes

March 22, 2017

I.             CALL TO ORDER

Acting Chairman Thomas Horan called the regular meeting of the Zoning Board of Appeals to order at 7:01 P.M. in the Main Meeting Room located at 933 Hopmeadow Street, Simsbury, CT.  The following members were also present:  Steve Antonio, Dennis Fallon, JoAnn Hogan, Thomas Horan and Diane Madigan.  Also present were Robin Newton, Code Compliance Officer and Leslie Brigham, Clerk. 

 

 

II.            ROLL CALL

 

1.            Appointment of Alternates

 

Acting Chairman Horan appointed Ms. Madigan for Ms. Blackburn.

 

Acting Chairman Horan appointed Mr. Fallon to serve as Secretary.

 

 

III.           APPLICATIONS

 

Mr. Fallon read into the record the legal notice for the Town of Simsbury Zoning Board of Appeals regular meeting for March 22, 2017 that included the following application:

 

1.            Public Hearings

 

a.            Application #17-01 of Jamie Wolf, Wolfworks, Inc. Owner, for a variance to the rear yard setback, pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations to accommodate the replacement and expansion of an existing deck on the residence on the property located at 21 Terry’s Plain Road (Assessor’s Map H11, Block 104, Lot 002A).  Zone R-40.  (public hearing must be opened by 3/22/82017; must be closed by 04/26/2017)

 

Mr. Wolf discussed his application on the replacement of a deck located at 21 Terry’s Plain Road.  He noted that there currently is a non-conforming use that had been approved by the Town.  Mr. Wolf stated that when the survey was completed, the rear property line is where the river is. 

 

It was noted by Ms. Newton that the change in the deck is extremely small and is actually being reduced in size.

 

Mr. Richard Warters, 28 Pilfershire Lane, explained what they are trying to accomplish with the new deck.

 

 

Acting Chairman Horan closed the Public Hearing.

 

 

2.              Discussion and Possible Action

 

a.            Application #17-01 of Jamie Wolf, Wolfworks, Inc. Owner, for a variance to the rear yard setback, pursuant to Article Eight, Section A, of the Simsbury Zoning Regulations to accommodate the replacement and expansion of an existing deck on the residence on the property located at 21 Terry’s Plan Road (Assessor’s Map H11, Block 104, Lot 002A).  Zone R-40.  (public hearing must be opened by 3/22/82017; must be closed by 04/26/2017)

 

Mr. Fallon made a motion to approve Application #17-01 for a variance that is granted in accordance to the deck shown on plans entitled, “Site Plan for The Warters’ Residence, Parcel 31872400, 21 Terry’s Plain Road, Simsbury, CT,” Prepared by David F. Whitney, Consulting Engineers, LLC, 21 Arch Road, P.O. Box 1605, Avon, Connecticut 06001, Scale 1”=20’ Dated 2/28/17, Sheet 3 of 3.  The variance is limited to the deck shown on the referenced plans.  Ms. Horan seconded the motion.

 

Board members briefly discussed Application #17-01.

 

Board members voted 5(five) Yes and 0 (zero) No.  The motion has passed.

 

 

IV.          OTHER MATTERS AS MAY PROPERLY COME BEORE THIS COMMISSION

 

No other matters discussed at this meeting.

 

 

V.  GENERAL COMMISSION BUSINESS

 

This was not discussed at this meeting

 

 

VI. APPROVAL OF MINUTES of December 21, 2016

 

                Mr. Fallon made a motion to approve the minutes for December 21, 2016.  Ms. Hogan seconded the motion.  All were in favor and the motion passed.

 

 

VII.    ADJOURNMENT

 

                Mr. Antonio made a motion to adjourn the meeting at 7:12 p.m.  Mr. Fallon seconded the motion.  All were in favor and the motion passed.
