ZONING BOARD OF APPEALS

Regular Meeting Minutes

June 26, 2018

I.             CALL TO ORDER

Chairman Katie Martin called the regular meeting of the Zoning Board of Appeals to order at 7:02 P.M. in the Main Meeting Room located at 933 Hopmeadow Street, Simsbury, CT.  The following members were also present Tom Horan, Dennis Fallon, JoAnn Hogan, Diane Madigan, and Steven Antonio.  Also present were Robin Newton, Code Compliance Officer

 

II.            ROLL CALL

None

 

III.           APPLICATIONS

 

Tom Horan read into the record the legal notice for the Town of Simsbury Zoning Board of Appeals regular meeting for June 26, 2018 that included the following applications:

 

1.            Public Hearings

 

Application #18-02 of Galvin Properties V, LLC, Owner, for a use variance to permit diesel engine repair on the property located at 38 Wolcott Road (Assessor’s Map I03, Block 439, Lot 010). Zone I-1. (public hearing set to open 06/27/2018)

 

Chairman Martin opened the public hearing.  The applicant John Gavin of Galvin Properties V, LLC was present to give a brief presentation on the application.  After Mr. Galvin’s presentation Code Compliance Officer Newton asked the members if the saw the memo from the Zoning Commission and handed out a memo from the Planning Commission that was provided by the Director today.  After reviewing the memos a discussion entailed regarding the use and its appropriateness and the opinion of the Zoning Commission that the request for a use variance is not appropriate and that the appropriate course for this change would be as a text amendment to the Zoning Commission.  After some conversation concerning the matter the applicant withdrew his application and stated he would seek a text amendment.  The ZBA members discussed sending a memo to the Zoning Commission supporting the use as a text amendment that is appropriate for the zone. 

 

2.              Discussion and Possible Action

IV.  GENERAL COMMISSION BUSINESS

 

Code Compliance Officer Newton informed the Board that the Director of Planning & Community Development, Jamie Rabbitt announced his resignation and his last day would be on Friday. 

 

V. APPROVAL OF MINUTES MAY 23, 2018

Dennis Fallon made a motion to approve the minutes of May 23, 2018.  The motion was seconded by Tom Horan.  Steve Antonio had one change to the minutes on line 40, “would no work, changed to would not work”. Motion to accept the minutes with the change were approved unanimously 6-0.

 

VI.    ADJOURNMENT

 

                Mr. Fallon made a motion to adjourn the meeting at 7:35 p.m.  Mr. Antonio seconded the motion.  All were in favor and the motion passed.
