ZONING COMMISSION - REGULAR MEETING
ADOPTED MINUTES
JUNE 17, 2013

I. CALL TO ORDER


Robert Pomeroy, Chairman, called the regular meeting for the Simsbury Zoning Commission to order at 7:04PM on Monday, June 17, 2013 in the Main Meeting Room of the Simsbury Town Offices located at 933 Hopmeadow Street, Simsbury, CT. The following members and alternates were present: Edward Pabich, Dave Ryan, Ed Cosgrove and Vaughn Marecki. Others in attendance included other interested parties.

II. APPOINTMENT OF ALTERNATES

Commissioner Pomeroy appointed Commissioner Cosgrove for Commissioner Salls and Commissioner Marecki for Commissioner Fiske. 


III. APPROVAL OF MINUTES of the June 3, 2013 Regular Meeting

The minutes from June 3, 2013 were adopted with one change presented by Commissioner Pabich.


IV. PUBLIC HEARING(s)

Commissioner Pabich read the legal notice regarding the following items:
1. Application #13-26 of Ensign-Bickford Realty, Owner, for a Special Exception pursuant to Article Ten, Section D, of the Simsbury Zoning Regulations for excavation and removal of materials on the property located at 437 Hopmeadow Street (Map F13, Block 103, Lot 005-3). Zone I-2.
2. Application #13-31 of Mark Nolan, Agent for the Town of Simsbury, Owner, for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for a series of events on the property located at 73 Wolcott Road (Map I02, Block 439, Lot 002). Zone I-1.
3. Application #13-32 of David M. and Sherryl Cordani, Owners, for a Special Exception pursuant to Article Seven, Section C.9, of the Simsbury Zoning Regulations for an accessory dwelling unit on the property located at 32 Lucy Way (Map I13, Block 109, Lot 018). Zone R-80.
4. Application #13-33 of Gifts of Love, Agent for the Town of Simsbury, Owner, for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for an event on the property located at 73 Wolcott Road (Map I02, Block 439, Lot 002). Zone I-1.
Application #13-26 - Gus Jasminski, Ensign-Bickford Realty, addressed the Commission regarding their preparation of the site for excavation. Mr. Jasminski provided some specifications and technical details of the proposed work involved in preparing the site. At this point in the presentation, Robert Stevens, Stevens Land Architecture, addressed the Commission. Mr. Stevens provided details regarding the wetlands on the property and other existing conditions on the site. Mr. Stevens presented plans illustrating the grading plan, topography and proposed landscaping materials. He also spoke about construction sequencing and how it will help minimize erosion. The number of material truckloads were discussed further as a result of a question by the Commission. Timing of the project and grading/elevation was then discussed further.


Ken Williams, 1 Candlewood Court, asked about, and expressed concern regarding, the truck activity and timing that will come with this excavation process. He also inquired about water run-off.
Application #13-31 - Lori Davis spoke on behalf of Mr. Nolan and gave a brief presentation regarding the Farm-to-Table dinners to be held at the Community Farm of Simsbury, for which they are applying for a temporary liquor permit. She spoke about attendance limits, the specified rain dates for the events and the liquor that will be served.


Application #13-32 - It was requested that this item be left opened and continued next week.


Application #13-33 - Deb Galli, Gifts of Love, spoke about the fund raising event, to be held at Community Farm of Simsbury, for which they are applying for a temporary liquor permit. She spoke about the fundraiser details regarding attendance, location, drinks, parking and hours of operation. There was a discrepancy regarding the drinks to be served, as the application specifically stated beer and wine only and Ms. Galli stated it would be a full bar.


Commissioner Pomeroy suggested leaving Application #13-26 open until they are able to receive staff feedback/recommendation and plan to wrap it up at the July 1, 2013 meeting.


Commissioner Pabich moved to close the public hearing on Application #13-31. The motion was seconded by Commissioner Ryan and was unanimously approved.

Regarding Application #13-33, Commissioner Pomeroy stated the Commission can vote on the application as it is presented, but if they do intend to serve more than beer and wine, they will have to come back in front of the Commissioner again.

Commissioner Cosgrove moved to close the public hearing on Application #13-33. The motion was seconded by Commissioner Pabich and was unanimously approved.


Commissioner Pabich moved for approval of Application #13-31 of Mark Nolan, Agent for the Town of Simsbury, Owner, for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for a series of events on the property located at 73 Wolcott Road. The motion was seconded by Commissioner Cosgrove which was unanimously approved.


Commissioner Ryan moved for approval of Application #13-33 of Gifts of Love, Agent for the Town of Simsbury, Owner, for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for an event on the property located at 73 Wolcott Road. The motion was seconded by Commissioner Marecki which was unanimously approved.  Commissioner Pomeroy noted, regarding the events to be held at Community Farms of Simsbury, the applicants will have to work with Town Staff as to the parking, lighting, safety, gathering permit, etc.


V.  DISCUSSION AND POSSIBLE ACTION ON ANY AGENDA ITEM, INCLUDING:


1. Application #13-24 of Anthony Fruchtl, P.E., of Ayoub Engineering Inc., Agent for Franchise Realty Interstate Corporation, Owner, for a Site Plan Amendment on the property located at 22 Albany Turnpike, West Simsbury (Map A20, Block 503, Lot 002-B). Zone B-3.
Tony Fruchtl, Ayoub Engineering, Inc., addressed the Commissioner regarding a remodeling project of the McDonald’s located at 22 Albany Turnpike. He spoke about the proposed renovation and provided some specifications of the project. Parking was discussed specifically, as was site signage, elevation, car circulation, ingress/egress and timing.


Commissioner Pabich moved for approval of Application #13-24 of Anthony Fruchtl, P.E., of Ayoub Engineering Inc., Agent for Franchise Realty Interstate Corporation, Owner, for a Site Plan Amendment on the property located at 22 Albany Turnpike, West Simsbury. The motion was seconded by Commissioner Ryan which was unanimously approved.


VI. STATUS OF:


1. Village District project - brief updated was provided. 2. Marketing project - Commissioner Pabich said the consultant has to set the next meeting.  3. RFQ for The Hartford - no update.


VII. ADJOURNMENT


Commissioner Ryan moved to adjourn the June 17, 2013 Regular Meeting of the Zoning Commission at 8:07PM. The motion was seconded by Commissioner Marecki and passed unanimously.
