ZONING COMMISSION – REGULAR MEETING – 7:00 PM

MINUTES – SUBJECT TO VOTE OF APPROVAL

JULY 25, 2016

I.      CALL TO ORDER

Commissioner Dave Ryan called the Regular Meeting for the Zoning Commission to order at 7:00 p.m. on Monday, July 25, 2016 in the Main Meeting Room of the Simsbury Town Offices located at 933 Hopmeadow Street, Simsbury, CT. The following members were present: Bruce Elliott, Donna Beinstein, Kevin Gray and Derek Peterson. Others in attendance included Jamie Rabbitt, Director of Planning and Community Development, Mike Glidden, Assistant Town Planner and other interested parties. Commissioner Mike Doyle arrived at 7:03 pm.

II.     ROLL CALL

1.            Appointment of Alternates:

Commissioner Ryan appointed Commissioner Elliott for Commissioner Post.  At 7:03 pm, Commissioner Ryan appointed Commissioner Doyle for Commissioner Battos.

III.    APPROVAL OF MINUTES of the July 11, 2016 Regular Meeting

Commissioner Elliott moved to approve the minutes dated July 11, 2016 as submitted.  Commissioner Gray seconded the motion and it was unanimously approved.  Commissioner Ryan said the minutes from July 18, 2016 Special Meeting don’t need approval.

IV.    APPOINTMENT OF ASSISTANT ZONING ENFORCEMENT OFFICER:

Mr. Jamie Rabbitt said he is applying for Assistant Zoning Enforcement Officer in the event an application requires a signature while Michael Glidden, Assistant Town Planner and Robin Newton, Code Compliance Officer, are out of the office.

 

Commissioner Gray moved to appoint Mr. Jamie Rabbitt as Assistant Zoning Enforcement Officer. The motion was seconded by Commissioner Peterson and was unanimously approved.

 

V.   PUBLIC HEARINGS:

i. Application #16-14 of Marc Lubetkin, Red Stone Pub, Agent; George Markatos, Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for a series of one-day events to be held on the property located at 10 Jim Gallagher Way (Assessor’s Map G10, Block 227, Lot 001A-RR). Zone SC-3. (public hearing opened 05/02/2016 and continued to 07/25/2016; public hearing must be closed by 08/10/2016 with extension that was granted).

 

Mr. Mark Lubetkin, Owner of Red Stone Pub, said he is applying for a liquor permit for the Oktoberfest event.  He has held this event for the past five years. Mr. Lubetkin added that he isn’t applying for the other events listed in the application since he is having some challenges with the landlord. Additional perimeter controls will be added, such as yellow caution tape, additional volunteers patrolling the area to ensure alcohol isn’t brought off the property. Mr. Lubetkin requested for the music to continue until midnight rather than 10:00 pm.

Commissioner Peterson moved to close the public hearing at 7:13 pm for Application #16-14 of Marc Lubetkin, Red Stone Pub.  Commissioner Gray seconded the motion and it was unanimously approved.

ii.  Application #16-26 of T.J. Donohue, Agent; Simsbury Land Trust, Owner; for a Special Exception pursuant to Article Ten, Section E, of the Simsbury Zoning Regulations, OFF-STREET PARKING REGULATIONS, for Phase 1 of the parking area on the property located at East Weatogue Street (Assessor’s Map H11, Block 106, Lot 037A). Zones R-40 and R-80. (received 06/06/2016; public hearing opened 07/11/2016 and continued to 07/25/2016; public hearing must be closed by 08/15/2016).

 

Ms. Rita Jepsen of 137 East Weatogue Street said that the proposed parking lot is located in an historic district. She is concerned about the impact on the historic area as well as safety, aesthetics and wetlands. She added that when the parking lot is full, then people will park on the road which is unsafe for drivers, bikers and runners.  Ms. Jepsen questioned the cost of maintaining the parking lot and the nuisance issues with trash and kids to hanging out. Ms. Jepsen said that she would like to see a complete plan.

Ms. Katie MacQuattie of 133 East Weatogue Street said she lives across the street and has young children. She agrees with Ms. Jepsen’s comments and added that part of the street is crowded and drivers aren’t familiar with the turn in the road and tend to speed.

Ms. Sue Bednarcyk of 119 East Weatogue Street said she would like to see a complete application.  There are a lot of open-ended questions such as the budget, drainage, signage, and environmental issues such as oil from cars parked in the lot.

Mr. Bob Duguay of 11 Nod Brook Drive said he is a member of the Simsbury Land Trust and is requesting the public hearing to remain open until Mr. T. J. Donohue, Agent, is available to speak.

Mr. Jamie Rabbitt responded to Mr. Dugauay’s request and said the applicant or legal counsel representing the applicant (not a member of the association) has the authority to request an extension of the public hearing. Mr. Rabbitt added that Mr. Donohue is aware of the public hearing. He added that the Historic District doesn’t recommend approval of the application. 

After some discussion, the Commission agreed to keep the public hearing open in the event Mr. Donohue arrives later in the evening.

 

Commissioner Elliott moved to continue the public hearing until 8:30 pm on July 25, 2016 for Application #16-26 of T.J. Donohue, Agent. Commissioner Beinstein seconded the motion and it was unanimously approved.

 iii. Application #16-28 of Frank J. Lucca, Powdermen Spirits Company, LLC, Agent; 1&3 Mill Pond Partners, LLC, Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a liquor permit on the property located at 1 Mill Pond Lane (Assessor’s Map F11, Block 103, Lot 005-23). Zone I2. (received 06/06/2016; public hearing opened 07/11/2016 and continued to 07/25/2016; public hearing must be closed by 08/15/2016).

 

Mr. Frank Lucca answered questions from the Commission.  He described the lower level to include the still, bottling and “bonded” storage.  Upstairs will include the tasting room, office area, and seating. Mr. Lucca added that deliveries will be small enough to hand carry. He intends to keep the business small. He added if the business grows then he will move. 

 

Commissioner Gray moved to close the public hearing at 7:35 pm for Application #16-28 of Frank J. Lucca, Powdermen Spirits Company, LLC. The motion was seconded by Commissioner Beinstein and it was unanimously approved.

iv. Application #16-31 of Brian Denno, Denno Land Surveying, Agent; Frank J. Sidoti, Jr., Owner; for a Special Exception pursuant to Article Seven, Section 9, of the Simsbury Zoning Regulations for an accessory dwelling unit above the proposed garage on the property located at 9 Nod Brook Drive (Assessor’s Map C19, Block 510, Lot 044). Zone R-40. (received 06/20/2016; public hearing opened 07/11/2016 and continued to 07/25/2016; public hearing must be closed by 08/15/2016).

Mr. Chuck Shimkus, Attorney for the applicant, introduced Mr. Brian Denno of Denno Land Surveying & Consulting.

Mr. Brian Denno of Denno Land Surveying & Consulting said that the current garage will be torn down and a new garage will be constructed with an in-law apartment on the second floor.  Mr. Denno passed around pictures of the property to the Commission showing the wooded property and long driveway. The applicant showed a picture on his cell phone of the current garage to the Commission. Mr. Rabbitt said that a picture from the cell phone cannot be considered. Mr. Denno also discussed the traffic study and impact on the neighborhood.

For the record, Mr. Shimkus submitted to town staff the following: two affidavits, one petition of neighbors supporting the application; two emails objecting to the application; and one letter from Ms. Elizabeth Goldfarb rescinding her original statement objecting to the application.

Mr. Shimkus said that Mr. Frank Sidoti lives in the home with his wife, step children and in-laws. The in-law apartment will utilize the same utilities (well water).

Mrs. Mercuri stated that she is currently living in the same house as the applicant. Her daughter and son-in-law will continue to reside in the house when she and her husband move to the in-law apartment over the garage.

Mr. Bob Duguay of 11 Nod Brook strongly objects to the application.  He said that Mr. and Mrs. Mercuri had a fire in their home and are currently living with their son-in-law. The living area of the proposed structure is 990 sq. ft. but the entire structure is 2,500 sq. ft. Mr. Duguay also commented that the applicant isn’t converting an existing structure into an in-law apartment; they are building a new structure.  He added that the structure “excessive” in size and will disrupt his quality of life. Mr. Duguay thinks the structure will depreciate the property value of the homes on Nod Brook Drive. In addition, Mr. Duguay said that the structure is in the side lot and, as defined by code, you can’t have two structures in the front or side lots. Therefore, the structure can’t be built.

Mr. Monty MacNeil of Nod Brook said that he objects to the application because it doesn’t fit in the neighborhood and it will impact the value of homes.  He added that the in-law apartment might become a rental in the future.

Mr. Jeff Pinney of 7 Nod Brook said that he supports the applicant because they are taking care of family. He can see the structure from his home and it doesn’t impact his or his wife’s life.

Mr. Lenore Lynch of 12 Nod Brook said he sympathizes with the applicant but opposes the application. The in-law apartment will change the character in the neighborhood and decrease the property values.

Mr. Tom Downes of 13 Nod Brook said he also sympathizes with the situation. He originally thought it was a single floor 990 sq. ft. in-law apartment. Mr. Downes said he doesn’t want it to become a rental unit and the structure will have an impact on the neighborhood.

Ms. Lucille Duguay of 11 Nod Brook said that the photographs show foliage which blocks the view of the house. She referenced an article published in the Hartford Courant on July 24, 2016 indicating the local housing market for Simsbury. The article states the prices of houses in Simsbury has decreased 23.9% in the past year. Ms. Duguay added that property value is a concern if the structure is built.

Mr. John Link of 26 Westledge Dr. said he lives directly behind the applicant and hears their current backyard activities. He is concerned that it will become a rental unit in the future and the noise will increase.

Ms. Susan Downes of 13 Nod Brook said that she opposes the application because the structure is very large and easily visible when the leaves are off the trees. She is also concerned that the structure can be modified to have more rooms in the future.

Mr. Bill Barto of 16 Nod Brook said he would like to see other design plans. There are no other design plans other than the “barn” to take into account.

Mr. Chuck Shimkus addressed the Commission again stating that the new structure is 550 sq. ft in addition to the original. He added that the Commission can condition approval that the in-law apartment is only for family members. Also, Mr. Shimkus said that the structure is large, but the property is 8-9 acres and the applicant is willing to screen it.

Mr. Brian Denno said that additional parking would be required to meet town requirements.

Mr. Sidoti answered questions from the Commission.  He said the in-law apartment can be accessed through the garage and main house. The storage area is unheated and unfinished.

Mr. Jamie Rabbitt told the Commission that the picture of the barn is not representative of the floor plan provided.

Mr. Chuck Shimkus said the applicant is willing to extend the public hearing 65 days and will provide an accurate rendering of the floor plan with elevations. He provided a letter to town staff requesting the extension. Commissioner Elliott requested town staff to ask the town attorney to review the application since the structure is a replacement, not an expansion.

At this time, Commissioner Peterson requested to close the public hearing for Application #16-26 of T.J. Donohue since it is past the 8:30 pm deadline as indicated in the motion above.

Commissioner Ryan moved to amend the agenda to address Application #16-26 of T.J. Donohue, Agent; Simsbury Land Trust, Owner; for a Special Exception. The motion was seconded by Commissioner Doyle and was unanimously approved.

Commissioner Peterson moved to close the public hearing at 8:55 pm for Application #16-26 of T.J. Donohue, Agent; Simsbury Land Trust, Owner; for a Special Exception pursuant to Article Ten, Section E, of the Simsbury Zoning Regulations, OFF-STREET PARKING REGULATIONS. Commissioner Elliott seconded the motion and it was unanimously approved.

Commissioner Gray moved to continue the public hearing September 19, 2016 at the Simsbury Town Hall for Application #16-31 of Brian Denno, Denno Land Surveying, Agent; Frank J. Sidoti, Jr., Owner; for a Special Exception pursuant to Article Seven, Section 9, of the Simsbury Zoning Regulations for an accessory dwelling unit above the proposed garage on the property located at 9 Nod Brook Drive (Assessor’s Map C19, Block 510, Lot 044). Zone R-40. (received 06/20/2016; public hearing opened 07/11/2016 and continued to 07/25/2016; public hearing must be closed by 08/15/2016). Commissioner Peterson seconded the motion and it was unanimously approved.

v.  Application #16-32 of Cumberland Farms, Inc., Applicant; Joseph P. Williams, Esq., Shipman & Goodwin LLP, Agent; for Text Amendments to the Simsbury Zoning Regulations in Article Ten, Section C.3.h, and Article Ten, Section C.7.d, to permit owners of certain gasoline filling stations to replace their existing, manually-updated price signs set atop the gas pumps with identically sized LED pump toppers. (received 06/20/2016; public hearing set for 07/25/2016; public hearing must be closed by 08/29/2016).

Mr. Joe Williams of Shipman & Goodwin said his applicant is requesting a text change to allow modernization of gas prices displayed on top of gas pumps.  Currently, the prices are magnetic numbers manually changed by employees. Changing to digital signage would be more efficient and safer for employees. The signs have illuminated LED white numbers displayed perpendicular to the road, limiting visibility from the road.

Ms. Carolyn Parker, Cumberland Farms Sign Consultant, brought a sample of the LED sign displayed on top of the pumps. She said film can cover the numbers in order to dim the brightness; controls can also dim the lighting as well.

Commissioner Peterson commented that he is opposed to re-writing the regulations for the convenience of the owner.  He added that it’s up to Cumberland Farms to meet the town regulations. Commissioner Elliott said that the Planning Commission unanimously opposed the application.

Mr. Jamie Rabbitt told the Commission that the Planning Commission doesn’t recommend approval of the application based on current POCD guidelines. 

Commissioner Gray moved to close the public hearing at 9:25 pm for Application #16-32 of Cumberland Farms, Inc., Applicant; Joseph P. Williams, Esq., Shipman & Goodwin LLP, Agent; for Text Amendments to the Simsbury Zoning Regulations Commissioner Beinstein seconded the motion and it was unanimously approved.

 vi. Application #16-33 of Xi Yang, Agent; E and A/I and G Simsbury Commons, L.P., Owner; for a Special Exception pursuant to Article Seven, Section E.6a, of the Simsbury Zoning Regulations for the expansion of a restaurant into existing retail space in a B-3 Zone on the property located at 530 Bushy Hill Road (Assessor’s Map B20, Block 508, Lot 001-B). Zone B-3. (received 07/11/2016; public hearing set for 07/25/2016; public hearing must be closed by 08/29/2016).

Mr. Xi Yang said he is opening a Mongolian grill restaurant by combining an existing restaurant space with a retail store. He is applying for a full liquor license in order to serve Asian-style cocktails. The previous restaurant had a beer and wine liquor license.

 

vi. Commissioner Gray moved to close the public hearing at 9:27 pm for Application #16-33 of Xi Yang, Agent; E and A/I and G Simsbury Commons, L.P., Owner; for a Special Exception pursuant to Article Seven, Section E.6a, of the Simsbury Zoning Regulations for the expansion of a restaurant into existing retail space in a B-3 Zone on the property located at 530 Bushy Hill Road (Assessor’s Map B20, Block 508, Lot 001-B). Zone B-3. (received 07/11/2016; public hearing set for 07/25/2016; public hearing must be closed by 08/29/2016). Commissioner Doyle seconded the motion and it was unanimously approved.

 vii. Commissioner Gray moved to close the public hearing at 9:30 pm for Application #16-34 of Xi Yang, Agent; E and A/I and G Simsbury Commons, L.P., Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a full liquor license on the property located at 530 Bushy Hill Road (Assessor’s Map B20, Block 508, Lot 001-B). Zone B-3. (received 07/11/2016; public hearing set for 07/25/2016; public hearing must be closed by 08/29/2016). The motion was seconded by Commissioner Beinstein and was unanimously approved. 

 VI. OLD BUSINESS:

 i.   Applications

 1.  Commissioner Gray moved to approve Application #16-14 of Marc Lubetkin, Red Stone Pub, Agent; George Markatos, Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a temporary liquor permit for a series of one-day events to be held on the property located at 10 Jim Gallagher Way (Assessor’s Map G10, Block 227, Lot 001A-RR). Zone SC-3. (decision must be rendered within 65 days from close of public hearing). The following conditions apply:

a.            Approval is for a temporary liquor license for a one-day event to be held on September 24, 2016.

b.            Event hours shall be the following:  set-up start time: 8:00 am / End/clean-up: 2:00 am.

c.             Outdoor entertainment/music shall occur during the following hours: start time: 3:00 pm. /end time: Midnight.

The motion was seconded by Commissioner Elliott and was unanimously approved.

 2.  Commissioner Gray moved to table until September 19, 2016 Application #16-26 of T.J. Donohue, Agent; Simsbury Land Trust, Owner; for a Special Exception pursuant to Article Ten, Section E, of the Simsbury Zoning Regulations, OFF-STREET PARKING REGULATIONS, for Phase 1 of the parking area on the property located at East Weatogue Street (Assessor’s Map H11, Block 106, Lot 037A). Zones R-40 and R-80. (decision must be rendered within 65 days from close of public hearing).  Commissioner Beinstein seconded the motion and it was unanimously approved.

 3. Commissioner Gray moved to deny Application #16-27 of T.J. Donohue, Agent; Simsbury Land Trust, Owner; for a Site Plan Approval for Phase 1 of the parking area on the property located at East Weatogue Street (Assessor’s Map H11, Block 106, Lot 037A). Zones R-40 and R-80. (Site Plan - received 06/06/2016; decision must be rendered by 08/10/2016). Commissioner Beinstein seconded the motion and it was unanimously approved. The motion was seconded by Commissioner Beinstein and was unanimously approved.  Applicant failed to secure approval from the Historic District Commission for a certificate of appropriateness concerning the application.

 4.  Commissioner Gray moved to approve Application #16-28 of Frank J. Lucca, Powdermen Spirits Company, LLC, Agent; 1&3 Mill Pond Partners, LLC, Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a liquor permit on the property located at 1 Mill Pond Lane for the association of distillery and sale of liquor. (Assessor’s Map F11, Block 103, Lot 005-23). Zone I2. (decision must be rendered within 65 days from close of public hearing). The motion was seconded by Commissioner Beinstein and was unanimously approved.

 5.  Application #16-31 of Brian Denno, Denno Land Surveying, Agent; Frank J. Sidoti, Jr., Owner; for a Special Exception pursuant to Article Seven, Section 9, of the Simsbury Zoning Regulations for an accessory dwelling unit above the proposed garage on the property located at 9 Nod Brook Drive (Assessor’s Map C19, Block 510, Lot 044). Zone R-40. (decision must be rendered within 65 days from close of public hearing). The public hearing has been extended.

 6.  Commissioner Gray moved to approve Application #16-32 of Cumberland Farms, Inc., Applicant; Joseph P. Williams, Esq., Shipman & Goodwin LLP, Agent; for Text Amendments to the Simsbury Zoning Regulations in Article Ten, Section C.3.h, and Article Ten, Section C.7.d, to permit owners of certain gasoline filling stations to replace their existing, manually-updated price signs set atop the gas pumps with identically sized LED pump toppers. (decision must be rendered within 65 days from close of public hearing). Commissioner Beinstein seconded the motion.  Commissioners Dave Ryan, Bruce Elliott, Donna Beinstein, Kevin Gray, Derek Peterson and Mike Doyle opposed the motion. The motion failed 0-6.

 7.  Commissioner Elliott moved to approve Application #16-33 of Xi Yang, Agent; E and A/I and G Simsbury Commons, L.P., Owner; for a Special Exception pursuant to Article Seven, Section E.6a, of the Simsbury Zoning Regulations for the expansion of a restaurant into existing retail space in a B-3 Zone on the property located at 530 Bushy Hill Road (Assessor’s Map B20, Block 508, Lot 001-B). Zone B-3. (decision must be rendered within 65 days from close of public hearing). Commissioner Gray seconded the motion and it was unanimously approved.

8.   Commissioner Elliott moved to approve Application #16-34 of Xi Yang, Agent; E and A/I and G Simsbury Commons, L.P., Owner; for a Special Exception pursuant to Article Ten, Section H, of the Simsbury Zoning Regulations for a full liquor license on the property located at 530 Bushy Hill Road (Assessor’s Map B20, Block 508, Lot 001-B). Zone B-3. (decision must be rendered within 65 days from close of public hearing). Commissioner Gray seconded the motion and it was unanimously approved.

 9.  Application #16-35 of Matt Wittmer, Phase Zero Design, Agent; Mitchell Auto Group, Inc., Owner; for a Site Plan Amendment for changes to the façades on the buildings located at 384 Hopmeadow Street (Assessor’s Map F14, Block 145, Lot 001-2). Zone B-2. (Site Plan - received 07/11/2016; decision must be rendered by 09/14/2016).

Mr. Rabbitt said DRB voted 2-1 in favor of the design. He added that since the site plan is missing from the application, an extension is needed to meet the regulations.

Matt Wittmere of Phase Zero Design described details of the architectural redesign of the Volvo service and Volvo dealership buildings. The design will make the buildings look more modern.

Commissioner Beinstein said she thinks there should be less window panes on the garage bay doors so that it looks more modern as opposed to colonial. Mr. Stephen Mitchell said that he has to balance the Quick Lube design that Ford wants and yet keep with the traditional look of the town. Mr. Mitchell asked for a 65-day extension to submit a site plan.

 

Commissioner Gray moved to table until September 19, 2016  Application #16-35 of Matt Wittmer, Phase Zero Design, Agent; Mitchell Auto Group, Inc., Owner; for a Site Plan Amendment for changes to the façades on the buildings located at 384 Hopmeadow Street (Assessor’s Map F14, Block 145, Lot 001-2). Zone B-2. (Site Plan - received 07/11/2016; decision must be rendered by 09/14/2016). Commissioner Peterson seconded the motion and it was unanimously approved. Applicant is to provide a site plan for the Commission to review at the Sept. 19th meeting.

 VII. NEW BUSINESS

 1.  Receipt of New Applications:

 i.   Application #16-36 of James Brighenti, Agent; Simsbury 1820 House, LLC, Owner; for the replacement of the roof on the Carriage House on the property located at 731 Hopmeadow Street (Assessor’s Map G10, Block 203, Lot 001C+D). Zone SC-1. (decision must be rendered by 09/28/2016).

Mr. Jamie Rabbitt said that the roof on the Carriage House was 30 years-old and failing. The applicant applied for a building permit. The building permit was granted due to the emergency scenario, which is in accordance with the building code. 

Mr. James Brighenti, Owner of the 1820 House, showed the Commission a sample of the 3-tab shingle used on the Carriage House. He added that a new roof is also needed on the main house before the end of the year.

Commissioner Gray moved to approve Application #16-36 for a Zoning Permit to install a new roof (Carriage House) at 731 Hopmeadow Street. Commissioner Beinstein seconded the motion and it was unanimously approved. 

 ii. Application #16-37 of Luis Valentin, Agent; Thomas Ryan, Owner; for review in accordance with the Simsbury Center Code for a new retail establishment as well as sign permit on the property located at 928 Hopmeadow Street (Assessor’s Map H09, Block 227, Lot 002). Zones SC-1, SC-3. (decision must be rendered by 09/28/2016).

Mr. Jamie Rabbitt described the sign to the Commission. The raised lettering is ¾” and the goose-neck lighting will remain.

Commissioner Gray moved to approve Application #16-37 for Zoning Permit to establish a new retail store (Olive Oil, Vinegars, Spices, Specialty Foods and Art Gallery) and associated signage at 928 Hopmeadow Street, as described in Exhibit 2 through 5. Commissioner Doyle seconded the motion and it was unanimously approved.

 iii. Application #16-38 of James Brighenti, Agent; Simsbury 1820 House, LLC, Owner; for the replacement of the roof on the Main House on the property located at 731 Hopmeadow Street (Assessor’s Map G10, Block 203, Lot 001C+D). Zone SC-1. (decision must be rendered by 09/28/2016).

Mr. Jamie Rabbitt said that the application is to re-roof the main house.  He added that DRB and town staffs are in agreement of the application.

 

Commissioner Doyle moved to approve Application #16-38 for a Zoning Permit to install a new roof (Main House) at 731 Hopmeadow Street. The following conditions apply:

1. Prior to the issuance of a building permit, the Director of Planning and Community Development shall review and approve proposed shingle type (Timberline – HD/UltraHD – three tab architectural shingle – Charcoal being consistent with the Carriage House as proposed in Application #16-36

Commissioner Gray seconded the motion and it was unanimously approved.

 

VII.     GENERAL COMMISSION BUSINESS

1.            Executive Session

a.            Pending Litigation

The Commission didn’t enter into Executive Session.

2.            Discussion of New and Ongoing Projects

a.            Zoning Regulations revisions: General Discussion

Mr. Jamie Rabbitt said that Glen Chalder will meet with the Commission on August 29th.

At this time, Mr. T. J. Donohue spoke to the Commission stating that he intended to withdraw Application #16-26 today but staff didn’t receive the notification. 

IX.    ADJOURNMENT

Commissioner Gray made a motion to adjourn the meeting at 10:16 pm. Commissioner Peterson seconded the motion and it was unanimously approved.
